Resolution Number 15-02-03-03 RESOLUTION NO, 15-02-03-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, SUPPORTING THE ESTABLISHMENT OF THE JAIDEN LIBORIO, IKER LIBORIO AND MARICELA SANCHEZ ACT OR AMENDMENT TO THE CALIFORNIA UNIFORM HOUSING CODE ESTABLISHING SAFE OCCUPANCY LEVEL LIMITATIONS IN SINGLE FAMILY RESIDENCES WHEREAS, on January 20, 2015, seventeen residents, eight adults and nine children, were overcrowded into makeshift bedrooms located at 26500 La Zanja Street; and, WHEREAS, at approximately 9:15 a.m. on January 20, 2015, with nine residents at home, an accidental fire occurred; and, WHEREAS, nine people were injured in the fire and two, Jaiden Liborio age three, Iker Liborio age two, and Maricela Sanchez age 20, died as a direct cause of the fire; and, WHEREAS, a similar fire occurred on or about July 30, 2011, in the same neighborhood with eleven individuals overcrowded in a unit, however gratefully without loss of life; and, WHEREAS, the City of San Juan Capistrano has numerous valued residents who constitute poor working class immigrants who are incentivized to overcrowd residential units for socioeconomic reasons; and, WHEREAS, all residents regardless of their race, ethnicity, creed, socioeconomic class, or religious affiliation, have the right to life and the peaceful and safe enjoyment of their home; and, WHEREAS, the California Uniform Housing Code (UHC), dictates the allowable occupancy limits in single family homes in the State of California and prohibits the City from achieving safe living conditions; and, WHEREAS, the UHC (Section 503.2) governs for occupancy in homes by square footage and not number of bedrooms as originally planned for the community; and, WHEREAS, the overcrowding of single family residences overloads city services such as police and fire protection and has proven to jeopardize the lives and safety of residents. Page 1 of 2 2/3/2015 N0W, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano does hereby plea the California State Assembly and State Senate, by letter and receipt of this resolution, to introduce and support legislation requiring a more feasible limitation on housing occupancy rates in the State of California; and, BE IT FURTHER RESOLVED that any such act or amendment be named in honor of San Juan Capistrano residents Jaiden Liborio, Iker Liborio, and Maricela Sanchez who tragically died from injuries sustained in the January 20, 2015, fire.
