Resolution Number 14-08-19-04 RESOLUTION NO. 14-08-19-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING WATER SHORTAGE STAGE 2 WHEREAS, on January 17, 2014, Governor Brown declared a State of Emergency in California due to severe drought conditions, calling on all Californians to reduce water use by 20%; and, WHEREAS, on April 25, 2014, Governor Brown issued an Executive Order to strengthen the State's ability to manage water and habitat effectively in drought conditions, and calling on all Californians to redouble their efforts to conserve water; and, WHEREAS, the National Integrated Drought Information System reported that nearly 80% of the State was reported to be under "extreme" drought conditions at the end of June 2014; and, WHEREAS, there is no guarantee that winter precipitation will alleviate the drought conditions, leading to even more severe drought impacts if the drought u continues; and, WHEREAS, Water Code Section 1058.5 grants the State Water Resources Control Board the authority to adopt emergency regulations in certain drought years in order to prevent the waste and unreasonable use of water, and to promote water conservation; and, WHEREAS, on July 15, 2014, The State Water Resources Control Board adopted California Code of Regulations, Title 23, Sections 863, 864, and 865 as an emergency regulation ("Emergency Regulation"), remaining in effect for 270 days, unless deemed no longer necessary due to changed conditions, or renewed due to continued drought conditions; and, WHEREAS, Section 865 (b) (1) of the Emergency Regulation states: "To promote water conservation, each urban water supplier shall implement all requirements and actions of the stage of its water shortage contingency plan that imposes mandatory restrictions on outdoor irrigation of ornamental landscapes or turf with potable water." WHEREAS, the City of San Juan Capistrano is an "urban water supplier" as defined in Water Code Section 10617, and is therefore required to comply with the immediate requirements of the Emergency Regulation by implementing Stage 2 of its Page 1 of 2 approved Water Shortage Contingency Plan, which is codified at Sections 6-12.05 and 6-12.06 of Title 6, Chapter 12, of the San Juan Capistrano Municipal Code. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby declare that Stage 2 of its Water Shortage Contingency Plan be implemented, effective immediately; and, The City Manager is hereby authorized and directed to take all necessary action to implement Water Shortage Stage 2, which imposes, among other things, mandatory limitations on landscape irrigation, consistent with Title 6, Chapter 12 of the Municipal Code, as amended.
