The related agenda _i item, in a courtesy notice that I received on Thursday of last week (which was rescinded through a courtesy cancellation notice received the very next day, Friday) was entitled: "Consideration of Approving Construction Plans and Specifications for Sidewalk Improvements and t Americans with Disabilities Act (ADA) Access Ramps at three (3) Street Locations (CIP 10101 and 11109)" f CIP 11109 (Camino Lacouague Sidewalk) was created at your October 19, 2010 meeting and funds were authorized to be transferred from CIP 11108 (Rancho Viejo Road Rehabilitation). The Council's action was 4-0 and the following key comments were made: • "...the sidewalk would provide a safe area for kids to walk, rather than walking in the street • need to make sure that the kids are safe need to make sure that there are sufficient funds for the Rancho Viejo Rehabilitation project before funds are spent on the Lacouague sidewalk." There is no need to re-hash why the sidewalk is needed. Both of you are well aware of the concerns and CIP 11109 was created to address the problem. What concerns me is that this item is shelf ready to be advertised for bid and award the contract, yet it was pulled at the last minute. The only 1 explanation that has been offered is that revenue sources are down and so decisions about which CIP projects could continue to move forward, and which ones had to be deferred, had to be made. That is understandable. However, in this case, it does not appear that prior Council direction is being followed, and it would appear that your Staff is making the decision about which projects have priority and which get delayed, rather than engage the Council in this decision, because the full picture is not being presented. Agenda Item D14 asks you to authorize plans and bids for various pavement rehabilitation projects drawing on funds allocated from CIP 11108 (Rancho Viejo Road Rehabilitation) and CIP 07105 (Preventative Street Maintenance) budgets. CIP 11108 was originally allocated $1,255,000, and at the October 19th meeting, Council reallocated $350,000 towards CIP 11109 (Camino Lacouague Sidewalk), theoretically leaving $905,000 for rehabilitation of Rancho Viejo Road. The four locations in the City discussed in your staff report for tonight have estimated construction costs • breakdown as follows: a. Rancho Viejo Road - $750,000 b. Camino La Ronda neighborhood - $220,000 c. Paseo Rita - $50,000 d. Alleyways in the Village II and III - $230,000 As you can see from the above, there are sufficient funds remaining, even with the reallocation of $350,000 to CIP 11109, to carry out CIP 11108. (remaining allocation of$905,000 vs. an estimated construction cost of$750,000). There also appears to be dollars for standard contingencies, staff and contract administration. Making sure that the rehabilitation of Rancho Viejo Road project had j funds was the only stipulation made by the Council on October 19, 2010, to staff before allocating funds to the Camino Lacouague sidewalk project. Even if revenue sources are down, your Agenda Item identifies total funds of$1,340,000 being available, although I am not sure how that breaks out to each of the CIPs. jTonight, I urge you to act only on authorizing what was supposed to be accomplished through CIP 11108 for the rehabilitation of Rancho Viejo Road, which is referenced as item a. in you `f report. I respectfully request that you direct Staff to bring forward at your next meeting agenda the consideration to approve plans and to authorize bids for CIP 11109. Consideration of the other three I project locations (listed in your agenda report as items b. through d.) should be delayed until after CIP 11109 is sufficiently funded, and plans and bids authorized. Timing of construction of CIP 11109 is crucial and was planned to coincide with when school was out for summer and to be completed before school starts up again in September. It is my understanding that the estimated construction costs are significantly lower (at least $100,000 lower) for the CIP 11109 project than was originally estimated. The other paving rehabilitation projects listed with your Agenda Item D14 tonight do not have critical timing issues for the construction activity that would occur, as a sidewalk to serve school children does.
