SUBJECT: Consideration of a Resolution for Notice of Completion and Acceptance of
the Work for Construction of the Northwest Open Space Phase 1 Sanitary
Sewer Improvement Project (Boudreau Pipeline Corporation) (CIP 09209)
RECOMMENDATION:
By motion,
1. Adopt a Resolution declaring the work for the construction of the Northwest Open
Space Phase 'I Sanitary Sewer Improvement Project complete, accepted, and
approved; and,
2. Direct the City Clerk to process and record the Notice of Completion; and,
3. Authorize staff to release the Performance Bonds and Payment Bonds 35 days
after filing of the Notice of Completion and after any claims of lien have been
satisfied.
EXECUTIVE SUMMARY:
The Northwest Open Space Phase 1 Sanitary Sewer Improvement Project has been
constructed and is operational to the satisfaction of the City Engineer. The project is
ready for acceptance and the recordation of a Notice of Completion with the County
Recorder. Construction was completed at a total cost of $137,299.78, which is
$10,700.22 below the bid price of $148,000 and $32,900.22 below the contract amount,
(the 15% contingency amount of $22,200 was not needed for completion of the work).
DISCUSSION:
On December 2, 2014, the City Council approved a Construction Agreement with
Boudreau Pipeline Corporation in the amount of $170,200 for construction of the
Northwest Open Space Phase 1 Sanitary Sewer Improvement Project. Mitigation

monitoring, including archeological, paleontological and Native American monitoring,
was provided by McKeehan Environmental Consultants and nothing significant was
found. Staff performed construction inspection and concluded that the project was
constructer{ in accordance with the contract documents. Staff has contacted all
subcontractors and suppliers that have filed preliminary notices and found no pending
lien claims. Therefore, staff recommends close-out of the project in accordance with the
above recommendations.
FISCAL IMPACT:
No significant unforeseen circumstances were encountered during the course of
construction. Construction of the project was completed at a cost of $137,299.78,
$10,700.22 under the bid amount of $148,000. It should also be noted that the
contingency amount of$22,200 included in the construction contract will not be needed.
The sewer project is complete and operational and the total cost of the project, including
design, construction, environmental work, and surveying is $180,196. CIP 09209 has
adequate funds to cover these costs.
ENVIRONMENTAL IMPACT
• On May 6, 2014, a Notice of Intent (NOI) to adopt a Negative Declaration was
filed with the County Clerk.
• On August 26, 2014, a Notice of Determination was filed with the County Clerk
indicating that there is no substantial evidence in the record that the proposed
project, after imposition of the mitigation measures identified in the Mitigated
Negative Declaration, will have a significant effect on the environment.
• Mitigation measures, including archeological, paleontological, and Native
American monitoring, were provided during excavation activities as
recommended in the CEQA document and nothing significant was found.
PRIOR CITY COUNCIL REVIEW
• On August 19, 2014, the City Council approved the CEQA document and
authorized staff to receive bids.
• On December 2, 2014, the City Council approved a construction contract with
Boudreau Pipeline Corporation in the amount of $170,200 for construction of
the Northwest Open Space Phase 1 Sanitary Sewer Improvement Project.

COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS:
• On August 19, 2014, the Utilities Commission recommended the City Council
approve the CEQA document and authorize staff to receive bids.
• On November 18, 2014, the Utilities Commission recommended award of a
Construction Contract with Boudreau Pipeline and approval of the draft License
Agreement with Moulton Niguel Water District for the Northwest Open Space
Phase 1 — Sanitary Sewer Improvement Project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DECLARING WORK COMPLETED AS TO
PLANS AND SPECIFICATIONS FOR NORTHWEST OPEN SPACE
PHASE 1 SANITARY SEWER IMPROVEMENT PROJECT
WHEREAS, On December 2, 2014 the City of San Juan Capistrano
entered into a construction contract with Boudreau Pipeline Corporation for construction
of Northwest Open Phase 1 Space Sanitary Sewer Improvements; and,
WHEREAS, the City Engineer has evaluated the final quantities and cost
figures and recommend approval of the costs; and
WHEREAS, the City Engineer has evaluated the work and deemed that it
has been completed in accordance with the pians and specifications and recommend
approval and acceptance of the work.
NOW, THEREFORE, BE IT RESOLVED, by the City of San Juan
Capistrano as follows:
SECTION 1.The work required to be performed by said Contractor has been
completed.
SECTION 2.The total cost of said construction work is in the amount of$137,299.78.
SECTION 3.The work is hereby accepted and approved.
SECTION 4.The City Clerk is directed to forthwith forward a "Notice of Completion" to
the County Recorder of the County of Orange for recording.

That said work was completed on April 8, 2015, by said company according to plans and
specifications and to the satisfaction of the City Engineer of the City of San Juan Capistrano,and
that said work was accepted by the City Council of the City of San Juan Capistrano,as the owner,
32400 Paseo Adelanto, San Juan Capistrano, California 92675, at a regular meeting thereof held
on the 2nd day of June, 2015, by Resolution No. 15-06-02-
That upon said contract, The Fidelity and Deposit Company of Maryland was surety for the bonds
given by the said company as required by law.
