There haven't been many issues brought up this year with the discussions regarding the proposed merger of the District and City being the focus of most of our meetings. The MOU has been drafted to provide for meetings beginning in March to address the differences between City and District rules, regulations, salaries, benefits, etc. The major item in the MOU is the 3% salary increase which we'd like to get implemented soon so the employees get their retroactive pay before Christmas. We've also proposed a minor change to the vacation accrual to conform to City policy and our management employees' policy. Please feel free to call me before the meeting if you have any questions. San Juan Capistrano, California 92675 E7AU "I A[l7 gar1 1996-97 MEMORANDUM OF UNDERSTANDING BETWEEN THE CAPISTRANO VALLEY WATER DISTRICT AND THE CAPISTRANNO VALLEY WATER DISTRICT GENERAL EMPLOYEES SECTION 1. AGREEMENT This agreement is entered into by the parties on behalf of the Capistrano Valley Water District (District) and the Capistrano Valley Water District General Employees (General Employees) in accordance with the provisions of Section 3500-32510 Meyers-Milias, Brown Act. All provisions of this agreement are effective upon adoption of this agreement by the District Board of Directors unless otherwise specified. SECTION 2.. RECOGNITION The District recognizes the General Employees as the "recognized employee organization" for all employees within the unit of representation, consisting of regular full-time and part-time employees in the following classifications: Accounting Clerk, Accounting Technician, Assistant Engineer, Construction Inspector, Customer Service Representative, Conservation Coordinator, Engineering Technician, Mechanic, Meter Reader, Distribution Foreman, Production Foreman, Water Quality Technician, Water Technician 1, Water Technician II, Water Technician III, and any temporary employees on the District's payroll. SECTION 3. RULES AND REGULATIONS The personnel rules and regulations that govern wages, benefits, work conditions, standards of performance and conduct are contained in the Employee Handbook dated June 1996. This landbook replaces and supersedes all previous versions and previous MOUS. Changes agreed upon in this MOU through negotiations are to be incorporated with revised pages in the Employee Handbook. SECTION 4, SALARY AND BENEFITS Increase each Salary Range in the bargaining unit by 3.0% effective 711./1996. SECTION 5. INSURANCE The District agrees to continue the payment of health insurance premiums for General Employees and their eligible dependents. The rate to be paid by the District is capped at the prevailing HMO rate for the coverage in place on August 1, 1996. The District agrees to continue the Dental and Vision insurance for General Employees and their eligible dependents. The rate for Dental and Vision Insurance will be capped at the August 1, 1996 rates. I SECTION 6. VACATION BENEFITS Section 302 Vacation Benefits will be change to conform the District's accrual schedule with the current City Policy as outlined in their 10/15196 MDU. The only change is to change the accrual rate from 160 hours to 164 hours after more than 10 years service. No changes to maximum accrual or pay out is being made. SECTION 7. DISTRICT/CITY MERGER The proposed merger of the District with the City of San Juan Capistrano, scheduled for July 1, 1997 will require the incorporation of the District's Rule and Regulations into the City's. The District and the General Employees agree to begin meeting in March 1997 to address the issues of the merger and the impacts on the Rules and Regulations with the intent of resolving these issues prior to the effective date of the merger. SECTION 8. TERM The term of this agreement runs through.June 3 0, 1997. SECTION 9. SEPARABILITY The provisions contained in this agreement have been bargained for and agreed to independently, and no particular clause, condition, or agreement is contingent or dependent upon any other, therefore, should any such clause, condition, or agreement be held to be void or unenforceable, the remainder of the terms and conditions of this agreement shall remain in full force and effect. Brown Orange County Employees Association P;\ADri1T"6oFn ou 2 MEMORANDUM December 4, 1996 TO: All District Employees FROM: Ray Auerbach, General Manager SUBJECT: Approval of the 1996/97 Memorandum of Understanding - Retroactive Pay At Tuesday night's Board meeting, our 1996/97 Memorandum of Understanding (MOU) covering our salaries and benefits for the year was finally approved. We were delayed in completing the process this year due to an extended medical leave of the General Employees' representative, Rich Brown. Of great importance to all of us is the 3% salary increase that is retroactive to July 1., 1996. Your retroactive pay for this period is contained in the attached check. The other features of the MOU are as.follows: 1. Continuation of all health, dental and vision insurance benefits at the current rates. 2. Adjustment of annual accrual of vacation hours from 1.60 to 164 for employees with 10 years of service. 3. Upon merger with City, District employees will retain seniority and accrual rates for benefits as if we were always City employees. All accrued vacation, sick leave and other time off will be transferred. 4. Discussion with employees will begin in March 1.997 to address the impacts of the merger and to resolve the differences in City/District work rules, salaries, benefits, etc., prior to July 1, 1997.
