BETWEEN" CAPISTRANO VALLEY WATER. DISTRICT AND
CAPISTRANO VALLEY WATER DISTRICT MANAGEMENT EMPLOYEES
WHEREAS, the District's General Manager and authorized representative
of the District's Management Employees have met and conferred in good faith
and have reached a mutual understanding concerning certain Employer-
Employee matters.
NOW, THEREFORE, it is mutally agreed by the duly authorized District
and Management Employee representatives that the following shall consititute
their Memorandum of Understanding for the period of time commencing July
1, 1990 through Jane 30, 1991:
SECTION 1. SALARY
The District will provide a cost of living salary increase of 5.0% to all
Management employees, retroactive to July 1, 1990.
SECTION 2. SICK LEAVE BENEFI'T'S
The District will allow eligible employees to utilize a maximum of
ninety-six (96) hours per year of accumulated sick leave with pay in the event
of: 1) employee's presence is required elsewhere because of family medical and
dental appointments, serious illness, disability or death of a member of the
employee's immediate family; 2) official order to appear in court as a litigant
or as a witness; and 3) accident or emergency involving employee or
immediate family.
SECTION 3. AUTOMOBILE ALLOWANCE/MILEAGE REIMBURSEMENT
The District will increase mileage reimbursement from $0.21 to $0.26
per mile for miles driven on District business.

SECTION 4. MODIFIED WORE SCHEDULE
The District will allow employees to work a 44/36 flexible work schedule
where the employee works 44 hours one week and 36 hours the next week,
thereby working only nine (9) days in a two-week period. This is generally
done by working four (4) nine (9) hour days and one (1) eight (8) hour day one
week, and four (4) nine (9) hour days on alternate weeks.
This work schedule is subject to the approval of the employee's
Department head and the General Manager, and is contingent on staffing
requirements and assurance that there will be no decrease in service level to
the District's customers.
SECTION 5. ANNUAL PHYSICAL EXAMINATIONS
The District will arrange and pay for a comprehensive annual physical
examination for all 'Management Employees.
SECTION 6. VACATION
The District will allow an employee to transfer into the employee's
Deferred Compensation flan account, vacation hours accured in excess of
eighty (80) hours, provided the employee has used at least forty (40) vacation
hours during the last completed calendar year. This option will be available to
the employee twice a year and hours will be transferred at a rate of 100% of
the employee's current wage rate at the time of transfer. The maximum hours
transferred per calendar year shall be eighty (80) hours.
SECTION 7. CONTINUA'T`ION OF BENEFITS
All fringe benefits previously granted and currently in effect to

Management employees shall remain in full force and effect for fiscal year
1990--91, notwithstanding other provisions of the Memorandum.
SECTION 8. SEPARABILITY
The provisions contained in the Memorandum have been bargained for
and agreed to independently and no particular clause, condition, or agreement
is contingent or dependent upon any other; therefore, should any such clause,
condition, or agreement be held to be void or unenforceable, the remainder of
the terms and conditions of the Memorandum shall remain in full force and
effect.
SECTION 9. TERM OF MEMORANDUM
This Memorandum of Understanding shall be in effect from July 1, 1990
to June 30, 1991.
