Dumhart, Principal Management Analyst SUBJECT: Consideration of License Agreement to Establish Public Parking on the Former ARCO Property - (Stroscher Enterprise Partnership APN 124-170-14) RECOMMENDATION: By motion, approve the License Agreement with Stroscher Enterprise Partnership for the creation of public parking on the former ARCO station property and appropriate $87,000 to cover the cost of this License Agreement for FY 2000/01. SUMMARY: Stroscher Enterprise Partnership is the owner of a vacant, unimproved dirt parcel located on the corner of EI Camino Real and Ortega Highway. The site was formerly the host to the ARCO Fueling Station which closed December 1998. The station was razed in 1999 and the lot has been vacant since. The property is being utilized by the general public for parking purposes. However, in its vacant status it creates a blighted nuisance in the core of downtown. The City would like to temporarily improve the lot to better manage public parking. On May 4, 2000, the City received a letter from Stroscher Properties indicating a willingness to make the parcel available to the community. The letter has been provided as Attachment 1 to this report. By licensing this property the City can pave and landscape the lot which will reduce dust and litter problems. Furthermore, a paved lot can be striped to provide better managed public parking, traffic circulation, and use of the property. The former fueling station site has four driveways accessing the site. Two of the driveways are from Ortega Highway and two from EI Camino Real. Through the licensing and creation of a temporary parking lot these driveways can be consolidated to improve traffic circulation and movements at this critical intersection. Staff has negotiated a License Agreement with the property owner for the use of this land as a City parking lot. The License Agreement provided as Attachment 2 to this report, has a minimum three year term. Rent payments to the licensor would be$4,500 per month for the first six months and $3,000 per month thereafter. Additionally, City is to pay the FOR CITY COUNCIL AGE / 0-, AGENDA ITEM - 2 - August 1, 2000 property tax liability on the property during the term of its license obligation. The property tax liability is approximately $1,700 annually. At this time staff is recommending the City Council approve the License Agreement with Stroscher Enterprise Partnership to provide for additional temporary public parking inventory COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: Not applicable.. FINANCIAL CONSIDERATIONS: Staff estimates the ARCO property is capable of supporting 38 parking spaces. Driveway improvements, grading, paving, stripping and landscaping are anticipated to cost$45,000. Below is a comparison of costs incurred for providing similar temporary parking.
