5-1.102 PROMPT PAYMENT OF WITHHELD FUNDS TO SUBCONTRACTORS
The Contractor shall return all monies withheld in retention from the subcontractor within 30
days after receiving payment for work satisfactorily completed, even if the other contract work is
not completed and has not been accepted in conformance with Section 7-1.17, "Acceptance of
Contract," of Standard Specifications. Federal Law(49 CFR 25:29) requires that any delay or
postponement of payment"over'30 days may take place only for good cause and with agency's
prior written approval. Any violation of this provision shall subject the violating prime contractor
or subcontractor to the penalties, sanctions, and other remedies specified in Section 7108.5 of the
Business and Professions Code. This requirement shall not be construed to limit or impair any
contractual, administrative, or judicial remedies otherwise available to the Contractor or
subcontractor in the event of a dispute involving late payment or nonpayment by the Contractor
or deficient subcontract performance or noncompliance by a subcontractor.

ALL BIDDERS:
PLEASE NOTE: Itis the bidder's responsibility to verify that the UDBE(s)falls into one of the following
groups in order to count fowa`rds the UDBE contract goal: 1)African Americans; 2)Asian-Pacific
