00-0104_CAPISTRANO CORNERSTONE_First Amendment Curators Agreement FIRST AMENDMENT TO THE
CURATOR AGREEMENT
This First Amendment to the Curator Agreement (hereinafter referred to as "First
Amendment") is made and entered into this 4th day of January, 2000, by and between the
City of San Juan Capistrano, a municipal corporation, duly organized and existing under
and by virtue of the laws of the State of California, (hereinafter referred to as "City"), and
Capistrano Cornerstone, Inc., a California non-profit Corporation (hereinafter referred to
as "Curator").
WITNESSETH
WHEREAS, the City and the Curator entered into an agreement on September 21,
1999, for Curatorship of the Montanez Adobe (hereinafter referred to as "Original
Agreement"); and,
WHEREAS, the City and Curator are mutually desirous of amending the original
agreement to eliminate the insurance provisions thereto; and,
- NOW THEREFORE, in consideration of the foregoing recitals, which are
incorporated herein by this reference, and the terms, covenants, and condition set forth in
this First Amendment, the Parties agree to amend the Original Agreement as follows:
Section A. On pages one and two of the original agreement, Section 3,
entitled "Compensation" shall be amended to read: "Cornerstone shall
receive no compensation from the City for services. The City will reimburse
Cornerstone for actual costs for improvements for which the City has granted
prior written approval."
Section B. On pages three and four of the Original Agreement, Section 13
entitled "Insurance Requirements," shall be deleted in its entirety.
Section C. Except for the two amendments above all other provisions of the
Original Agreement shall remain in full force and effect.
In Witness Whereof, the parties have read and understood the provisions contained in
this First Amendment and have executed and acknowledged this First Amendment as of
the day and year written above.
