A RESOLUTION OF THE SAN JUAN CAPISTRANO COMMUNITY
REDEVELOPMENT AGENCY BOARD OF DIRECTORS, ORDERING THE
VACATION OF A 12 -FOOT -WIDE ACCESS EASEMENT AS SHOWN WITHIN
PARCELS 4 AND 5 OF PARCEL MAP 85-306, RECORDED IN BOOK 223,
PAGE 12 OF MISCELLANEOUS MAPS, COUNTY OF ORANGE, ASSESSOR
PARCEL NO. 121-240-75 (TOYOTA/KEMPER)
WHEREAS, the San Juan Capistrano Community Redevelopment Agency is the
holder of a 12 -foot -wide easement for access purposes within the subject property; and,
WHEREAS, the property owner, Kemper Realty, has requested the subject easement
be vacated to accommodate development of a Toyota dealership; and,
WHEREAS, the Board of Directors has heard and received testimony regarding this
item; and,
WHEREAS, the San Juan Capistrano Community Redevelopment Agency has
determined That the easement is no longer usable by the public due to the easement's narrow width
and conflicts with railroad crossing issues.
NOW, THEREFORE, BE IT RESOLVED, by the San Juan Capistrano Community
Redevelopment Agency Board of Directors as follows:
the vacation proceedings are to be conducted under the Streets and Highways Code
Section 8320 et seq.
SECTION 2.
The Board of Directors hereby orders the vacation of the access easement shown on
Exhibit A, attached hereto.
SECTION 3,
The Chairman and Agency Secretary are hereby authorized to execute the Resolution
and the Vacation Deed.

The Agency Secretary is hereby directed to forward the documents to the Orange
County Recorder's Office.

SECTION 5.
The four sections indicated above shall not be effective until the transfer of property
from Kemper to Toyota is completed.
