Ordinance Number 977ORDINANCE NO. 977 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING ARTICLE 5 AND ADDING ARTICLE 6 OF CHAPTER 2 OF TITLE 2 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE ORGANIZING THE OPEN SPACE, TRAILS AND EQUESTRIAN COMMISSION AND ORGANIZING THE PARKS, RECREATION, AND SENIOR SERVICES COMMISSION. The City Council of the City of San Juan Capistrano, California, DOES HEREBY ORDAIN as follows: SECTION 1. Article. 5 of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby amended to read as follows: Article 5. — Open Space, Trails and Equestrian Commission. Sec. 2-2.501. — Created. An Open Space, Trails and Equestrian Commission for the City is hereby created. Sec. 2-2.502. — Duties. The Open Space, Trails and Equestrian Commission shall undertake and have the following duties, responsibilities, and functions, together with the powers incidental thereto: (a) To review and make recommendations to the Planning Commission concerning tentative maps with regard to their relationship to the City's Open Space, and Equestrian and Recreation Trails Plan as identified in the Conservation and Open Space, and Parks and Recreation Elements of the General Plan of the City; (b) To review and make recommendations to the City Council or Planning Commission on capital improvement plans for recreational trails which are developed to implement the Conservation and Open Space, and Parks and Recreation Elements of the City's General Plan; (c) To study and make recommendations to the City Council or Planning Commission on proposed amendments to the Conservation and Open Space, and Parks and Recreation Element of the City's General Plan, (d) To study and make recommendations to the Planning Commission on proposed design standards for private and public recreational facilities including bicycle, hiking and equestrian trails, and equestrian facilities for the boarding, training and raising of horses; 0977 (e) To review and make recommendations to the City Council on preservation andlor acquiring additional open space, including identifying areas to be acquired and funding strategies for acquisition; (f) To make recommendations to the City Council on strategies for how future planning for land use and infrastructure should be accomplished, including funding strategies for future planning and environmental work affecting open space in the City. (g) To study and make recommendations.to the City Council on the management of the City's open space and ways to ensure long-term financial return to maintain and enhance the City's open space. (h) To undertake such other duties as may be assigned by the City Council. SECTION 2. Article 6 of Chapter 2 of Title 2 of the San Juan Capistrano Municipal Code is hereby adopted to read as follows. Article 6. -- Parks, Recreation, and Senior Services Commission Sec. 2-2.601. - Created. A Parks, Recreation, and Senior Services Commission for the City is hereby created. Sec. 2-2.602. - Duties. The Parks, Recreation, and Senior Services Commission shall undertake and have the following duties, responsibilities, and functions, together with the powers incidental thereto: (a) To review and make recommendations to the Planning Commission concerning tentative maps with regard to their relationship to the City's Parks and Recreation Programs; (b) To review and make recommendations to the Planning Commission on capital improvement plans for parks which are developed to implement the Piarl�s and Recreation Element of the City's General Plan; (c) To study and make recommendations to the Planning Commission on proposed amendments to the Parks and Recreation Element of the City's General Plan; (d) To study and make recommendations to the Planning Commission on proposed design standards for private and public parks; (e) To study and make recommendations to the Community Services Department on existing and proposed recreational programs and services for the City's residents, including youth and senior citizens; 2 0977 (f) To undertake such other duties as may be assigned by the City Council. SECTION 3. SEVERABILITY. If any section, subsection, clause or phrase of this Ordinance or any part thereof is for any reason held to be invalid, unconstitutional or unenforceable by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portion of the Ordinance. The City Council declares that it would have passed each section, subsection, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, sentence, clause or phrase would be declared invalid, unconstitutional or unenforceable. SECTION 4. CERTIFICATION. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same,. in the Office of the City Clerk.
