Ordinance Number 934ORDINANCE NO. 934 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING CODE AMENDMENT CA 07-01 RELATING TO SIGN REGULATIONS SET FORTH IN MUNICIPAL CODE SECTION 9-3.543, TABLE 3-42 WHEREAS, the San Juan Capistrano City Council has directed that the City's sign provisions be reviewed to provide more detailed regulation of signs pertaining to monument signs, building mounted signs, office complex signs and signs in view corridors; and, WHEREAS, staff has prepared an amendment to the sign regulations set forth in Section 9-3.543, Table 3-42 of the Municipal Code; and, WHEREAS, the code amendment was reviewed in compliance with the California Environmental Quality Act (CEQA) Guidelines, an Initial Study was performed and potentially significant impacts were identified regarding Aesthetics. Mitigation Measures have been included to reduce potential impacts to insignificant levels. A Mitigated Negative Declaration was prepared; and WHEREAS, the Planning Commission conducted duly -noticed public hearings on September 25, 2007 and October 9, 2007 pursuant to Section 9-2.335 of the Municipal Code, City Council Policy 5, and Planning Department Policy 510 to consider public ' testimony on the proposed amendment and has considered all relevant public comments. WHEREAS, the City Council conducted duly noticed public hearings on November 6, 2007, December 4, 2007 and December 18, 2007; and WHEREAS, the City Council carefully considered public oral and written communications at the public hearing. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Code Amendment CA07-01. San Juan Capistrano Municipal Code Section 9-3.543, Table 3-42 is amended pursuant to provisions set forth in Exhibit "A". Section 2. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its passage. Section 3. City Clerk's Certification The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days priorto the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
