Ordinance Number 900ORDINANCE NO. 900 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING COMPREHENSIVE DEVELOPMENT PLAN (CDP) 81-01, FORSTER CANYON PLANNED COMMUNITY, "R&D" (RESEARCH & DEVELOPMENT -OFFICE) DISTRICT STANDARDS. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Recitals and Findings. Centra Realty requests approval of an amendment to the "R&D" (Research & Development -Office) District regulations, Section V.D.10.f., Development Standards, and specifically, subsection 3(a), Roofs and subsection 8, Minimum Width of Landscaped Areas, established by Comprehensive Development Plan (CDP) 81-01, Forster Canyon Planned Community. 2. The proposed project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code. 3. The Environmental Administrator has determined thatthe project's potential impacts have been fully addressed through the previously certified Final Environmental Impact Report for Pacific Point and the executed Development Agreement, determined that the project is exempt from Department of Fish and Game Fees, and referred the site and architectural plans to the Design Review Committee and the Planning Commission, referred potential text amendments for the Comprehensive Development Plan to the City Council. 4. The Planning Commission conducted a duly -noticed public hearing on September 14, 2004 pursuant to Title 9, Land Use Code, Section 9-2.335, City Council Policy 5, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comments. 5. The proposed zone change, amending Sections Section V.D.10.f.3(a) and Section V.D.10.f.8, is consistent with the General Plan goals, policies, and objectives, in particular, the provisions of the Land Use Element and the Community Design Element because the recommended development standards will allow office development consistent with the General Plan land use designation for the property, and the recommended development standards include appropriate criteria to assure consistency with the purpose and intent of the "R&D" (Research & Development - Office) District and the Pacific Point Design Guidelines. 6. The proposed zone change is consistent with the General Plan designation for the project site because the text amendments will facilitate the development of office use which is consistent with the General Plan's Planned Community designation 01-05-2005 -1- and the development of "light industrial" pursuant to Table LU -3, Planned Communities, Allowable Use Guidelines; and, The proposed zone change will result in the development of land uses suitable to the property's unique situation including natural and man-made constraints because the recommended text amendments will result in development standards which will allow site development consistent with the project site's natural and man-made constraints; and, The proposed zone change will be compatible with the existing land uses and/or zoning classifications of adjoining properties or properties in the vicinity of the property being rezoned which could potentially be affected by development because the recommended development standards will maintain compatibility of the proposed project with existing and proposed adjoining land uses. SECTION 2. Amendment. Comprehensive Development Plan (CDP) 81-01, Forster Canyon Planned Community, "R&D" (Research & Development -Office) District standards are hereby amended as provided by Exhibit "A" attached hereto and incorporated herein. passage. SECTION 3. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after its SECTION 4. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk. Minimum height of sloping roofs shall be 6 feet for single -story and 8 feet for two-story structures, measured vertically above the eave. Development Standards, Section V(D)(9)(f)(8), Minimum Width of Landscape Areas, is hereby amended as follows: (a) Between Parking Areas and One Story Buildings: 10'-0", provided the Planning Commission may reduce the minimum width to 5'-0" based on a determination that the total open area provided would meet or exceed that required under the stricter standard. (b) Between Parking Areas and Two Story Buildings: 15'-0", provided the Planning Commission may reduce the minimum width to 7'-6" based on a determination that the total open area provided would meet or exceed that required under the stricter standard.
