Ordinance Number 89328 ORDINANCE NO. 89 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO AMENDING ORDINANCE NO. 34, RELATING TO SIGNS AND DECLARING THE URGENCY THEREOF. The City Council of the City of San Juan Capistrano does hereby ordain as follows: SECTDN 1. That Ordinance No. 34 be and it is hereby amended by adding paragraph 8 to Section 2.02 of said Ordinance to read as follows: 118. Notwithstanding any of the provisions of this Ordinance temporary directional signs shall be permitted without variance, provided an agree- ment be made with the City providing: (a) Said signs pertain solely to the rental or sale of homes being construded within the residential subdivision or residential district involved. (b) Said signs shall be erected on property. -within the residential subdivision or residential district involved. (c) Said signs shall not exceed two hundred (200) square feet and contain only such matters as the name of the development, location of the development, the developers' name, the type of development and the price range thereof. (d) Said signs shall be removed within two (2) years from date of building permit. The City Council upon recommendation of the Planning Commission may grant additional one (1) year extensions of time provided said request is considered reasonable. (e) That a cash bond or corporate surety bond in the amount of $100.00 shall be deposited with the City Treasurer to assure the removal of said sign after expiration date. (f) That the applicant shall provide the City with a letter granting the City and its authorized agents the right of ingress and egress to and r from such sign location for the purpose of removal of such sign, and shall further stipulatersaid deposit shall be forfeited for the purpose of defraying the cost of removal. Said letter and surety to be provided the City prior to the issuance of a building permit for the sign." SECTION 2. EFFECTIVE DATE. This ordinance is an urgency ordinance and shall take effect immediately. The facts establishing such urgency are as follows: Through inadvertance and oversight the provisions for temporary real estate signs were omitted from general subdivision ordinance and two 329 different standards were imposed in other ordinances dealing with the matter. It is of utmost economic importance and of vital interest to the general welfare of the citizens of San Juan Capistrano that said inadvertant oversigh be remedied so that all may be treated the same under the law. In order that the public be protected immediately, it is necessary that this ordinance be adopted as an urgency measure. SECTION 3. This ordinance shall take effect immediately and within fifteen (15) days shall be published in the Coastline Dispatch, together with the names of the City Councilmen voting for and against the same.
