ORDINANCE NO. 86
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
JUAN CAPISTRANO, AMENDING ORDINANCE NO. 51, RELATING
TO THE CONSTRUCTION OF SWIMMING POOL SET BACK LINES
IN THE E-1, E-2 and E-3 ZONES WITHIN THE CITY OF
SAN JUAN CAPISTRANO.
The City Council of the City of San Juan Capistrano does ordain as
follows:
SECTION 1. That Ordinance No. 51 is hereby amended to correct certain
ambiguities therein as they relate to the construction of swimming pools
and the placement of such swimming pool structures on lots within the E-1,
E-2 and E-3 areas of the City of San Juan Capistrano.
SECTION 2. To permit the construction of swimming pools in the E-1
areas within the City of San Juan Capistrano and to designate the set back
lines applicable thereto, Ordinance No. 51 (and Ordinance No. 5) is amended
by deleting paragraph 5, under paragraph A, "Uses Permitted^, of Section G,
E-1, Large Estate District Regulations, and paragraph f, under paragraph
11, "Site Requirements" of said Section G, and substituting in lieu thereof
the following respective paragraphs:
115. One -family dwellings of a permanent character in a permanent
location, including a swimming pool, permanent guest cottages and employees'
quarters as specified under conditions hereinafter prescribed."
'If. The following set backs shall apply to all structures, including,
swimming pools, and shall be considered a minimum requirement, provided,
however, a swimming pool may occupy any portion of the front yard between
the side yard set back and to the rear of a line 10 feet from the front
property line."
SECTION 3. To permit construction of swimming pools in the E-2 areas
within the City of San Juan Capistrano and to designate set back lines
applicable therAo, Ordinance No. 51 (and Ordinance No. 5) is amended by
deleting paragraph 3, under Section H, E-2, Medium Estates District Reg-
ulations, and paragraph h, under paragraph 11, "Site Requirements" of
said Section H, and substituting in lieu thereof the following respective
paragraphs:
"3. One -family dwellings of a permanent character placed in a perman-
ent location, including a swimming pool, and one permanent guest cottage for
each building site."
"h. The following set back shall apply to all structures, including
swimming pools, and shall be considered a minimum requirement."
SECTION 4. To permit the construction of swimming pools in the E-3

areas within the City of San Juan Capistrano and to designate set back
lines applicable thereto,Ordinance No. 51 (and Ordinance No. 5) is amended
by deleting paragraph 3, under Section I, E-3, Small Estates District
Regulations, and paragraph f, under paragraph 8, "Site Requirements -
of Section I, and substituting in lieu thereof the following respective
paragraphs:
"3• One -family dwellings of a permanent character placed in a
permanent locathn, including a swimming pool and one permanent guest cottage
for each building site."
'If. The following set backs shall apply to all structures, including
swimming pools, and shall be considered a minimum requirement."
SECTION 5. The City Clerk shall certify to the passage and adoption
of this ordinance by the City Council of the City of San Juan Capistrano
at a regular meeting held on the 23rd day of March, 1964, and shall cause
the same to be published in the Coastline Dispatch within fifteen (15)
days after its passage.
