Ordinance Number 84310 ORDINANCE NO. 84 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO PROVIDING FOR VEHICLE REGULATIONS WITHIN THE CITY LIMITS OF THE CITY OF SAN JUAN CAPISTRANO, PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE NO. 32. The City Council of the City of San Juan Capistrano do ordain as follows: ARTICLE 1. GENERAL REGULATIONS SECTION 1. Unlawful to ride or drive on sidewalk. (a) Vehicle defined. The term "vehicle" as used in this Section shall include every animal drawn or self-propelled vehicle, and bicycles. (b) Vehicles not permitted on sidewalks. It is hereby declared unlawful for any person to drive any vehicle upon any sidewalk within the City of San Juan Capistrano, or obstruct any such sidewalk by the passage or conveyance of any vehicle. (c) Animals not permitted on sidewalks. It shall be and is hereby made unlawful for any person or persons to ride, lead, drive or propel any horse, or other beast of burden upon any sidewalk in this City, or to use, or obstruct any such sidewalk by the passage or conveyance of any such animal. SECTION 2. Use of certain tires restricted. It shall be unlawful for any person, firm or corporation, to operate or drive a motor or other vehicle along, upon or over any city street or highway or bridge of the City of San Juan Capistrano when such vehicle is equipped with tires, the outer circumference of which have a flat space or spaces thereon, which pound the surface of such street, highway or bridge, and/or as restricted by Section 27454 of the Vehicle Code of the State of California. SECTION 3. Heavy traffic. (a) Defined. Heavy traffic for the purpose of this Section is hereby defined to be any vehicle regardless of the motive power thereof, carrying a load including the weight of the vehicle in excess of twelve thousand pounds. (b) Resolution to prohibit heavy traffic. Whenever the City Council of the City of San Juan Capistrano shall by reso- lution prohibit heavy traffic on any City street, highway or boulevard in the City -and the said street or highway shall be posted as hereinafter provided, it 311 stall be unlawful for any person to use said street or highway for the purpose of heavy traffic. (c) Posting sign. Whenever the City Council shall pass a resolution prohibiting heavy traffic upon any street or highway in the City of San Juan Capistrano, the said City Coun- cil shall cause to be posted upon said street or highway at the intersection of said street or highway with all other streets and highways at or near each of such intersections a sign upon which shall be printed in letters, not less than two inches in height, the words "HEAVY TRAFFIC PROHIBITED". ARTICLE II. PARKING. SECTION 1. Traffic districts and zone designations. The City Council of the City of San Juan Capistrano, may by resolution: (a) Designate certain streets or portions of streets within the incorporated area of the City as Traffic District "A", "B" or "C". (b) Designate certain streets or portions of streets as "No Parking" areas. (e) Designate portions of streets as "Loading Zones". (d) Designate portions of streets as "Bus Stops". (e) Designate portions of streets as "Passenger Loading Zones". (f) Determine and select those streets and highways entering business or residential districts which shall be signposted. SECTION 2. Parking time limits. (a) Traffic District A. It shall be unlawful for the operator of a motor vehicle to stop said vehicle and leave the same so parked for a period of time longer than one hour between the hours of seven o'clock A.M. and six o'clock P.M. on any day within any Traffic District "A". (b) Traffic District B. It shall be unlawful for the operator of a motor vehicle to stop said vehicle and leave the same so parked for a period of time longer than two hours between the hours of seven o'clock A.M. and six o'clock P.M. of any day, within any Traf- fie District "B". (c) Traffic District C. The City Council of the City of San Juan Capistrano shall designate by reso- lution the specific time during which operators of any motor vehicle may park or stop the same within Traffic District "C". It shall be unlawful for the operator of any vehicle to stop or park said vehicle in excess of the time so limited by 312 resolution of the City Council. (d) Loading zones. (1) It shall be unlawful for the operator of any motor vehicle to park or stop the saw in any loading zone for any purpose other than the un- loading or loading of passengers or materials, provided that no stop for the loading or unloading of passengers shall be made for more than five (5) minutes, and provided that no stop for loading or unloading of materials shall be made for more than twenty (20) minutes. -, (2) It shall be unlawful for the operator of any motor vehicle to park or stop the same in any passenger loading zone for any purpose other than the unloading or loading of passengers, provided that no stop for the loading or unloading of passengers shall be made for more than five (5) minutes. (e) Bus stop. It shall be unlawful for the operator of any motor vehicle to stop or park said vehicle immediately adjacent to or opposite any curbing in the City of San Juan Capistrano which has been designated as a "Bus Stop" or where there are no curbings, within any area which has been signposted as a "Bus Stop", for any pur- pose other than the loading or unloading of passengers or freight; provided that no stop for the loading or unloading of passengers or freight shall be made for more than five (5) minutes. (f) No parking. It shall be unlawful to park any motor vehicle immediately adjacent to or opposite any curb which has been painted red and which has been marked to indi- cate or bear a sign indicating that no parking is permitted or, where there are no curbings, within any area which has been signposted as a "No Parking" area. (g) Maximum parking time limit. It shall be uhlawful to park, stop or leave sitting for a period of time longer than one hundred and twenty (120) consecutive hours upon any public street or highway in the incorporated area of the City of San Juan Capistrano, any vehicle,traetor, truck, any piece of farm machinery or special purpose machine, and any type of trailer, except trailer coaches which are restricted as provided in Subsection (h) herein. (h) Trailer coach, camp car. It shall be unlawful for any person to camp overnight or to park a trailer coach or camp car as defined in the State Health and Safety Coda, Sections 18001 313 and 18001.1, overnight upon any public highway, including any part of the right of way thereof. (1) Vehicle not in condition to be lawfully operated. It shall be unlawful to park, stop or leave sitting for a period of time longer than twelve (12) consecutive hours upon any public street or highway in the incorporated area of the City of San Juan Capistrano, any vehicle not in a condition to be lawfully operated on the public highways. (j) Traffic regulation on State highways. Any provisions of Subdivisions (g), (h) and (i), which regulate traffic or delegates the regulation of traffic upon State highways in any fray for which approval of the Department of Public Works is required by State law shall cease to be operative six (6) months after receipt by the City Council of a written notice of withdrawal of approval of the Department of Public Works. SECTION 3. Warning signs. When the City Council has designated any street or portion of street as Traffic District "A", "B" or "C", it shall be the duty of the Director of Public Works or the City Engineer of the City of San Juan Capistrano to cause to be posted at the boundary of such district a sign indicating thereon the time per- mitted for parking within such District. It shall be the duty of the Director of Public Works and/or the City Engineer of the City of San Juan Capistrano to designate. (a) Loading zones by painting the curb adjacent to such zones yellow, with the words "Loading Zone" painted in black letters thereon. Said loading zones shall not exceed fifty (50) feet in length. Where there are no curbs, the loading zone shall be designated by posting a sign at each end of the zone indi- cating that the area is a "Loading Zone". (b) Bus Stop zones by painting the curb adjacent to such zones red, with the words "Bus Stop" painted with black letters thereon, the areas of such bus stops to be determined by the Director of Public Works and/or City Engineer of the City of San Juan Capistrano. Where there are no curbs, the bus stop shall be designated by posting a sign at each end of the zone indicating that the area is a "Bus Stop". (e) No parking areas by painting the curb adjacent to such areas red, with the words "No Parking" painted thereon in white, or a sign indicating that no parking is permitted. Where there are no curbs, no parking areas will be desig- nated by posting a sign at each end of the area, and at intervals of not more 314 than eight hundred (S00) feet within the area indicating that the area is a "No Parking" area. (d) Areas within Traffic District "C" shall be marked by painting the curb within such district green and marking thereon in white paint words and figures indicating the time limit designated for such Traffic District. (e) Passenger loading zones by painting the curb adjacent to such zones white, with the words "Passenger Loading Zone" painted with black letters thereon. SECTION 4. Tow Away Zone. Whenever the City Council by resolution shall have established any area as a "No Parking Area" as in this Article provided, the City Council may, at the sacra time or thereafter, by resolution determine that any one or more of the cir- cumstances described in Section 22652 of the Vehicle Code of the State of Calif- ornia exist as to such area, and may designate such area as a "Tow Away Zone". Whenever the City Council shall have designated any area as a "Tow Away Zone" it shall be the duty of the Director of Public Works and/or the City Engineer of the City of San Juan Capistrano to cause signs to be posted, giving notice that any vehicle parked in such "Tow Away Zone" may be removed. SECTION 5. Vehicle repair. It stall be unlawful to repair, dismantle, overhaul, or perform any mechan- ical work upon a vehicle, trailer, camp car or trailer coach on any part of any public street or highway in the incorporated area, except to replace or otherwise repair a tire or to make emergency repairs to enable such vehicle to be removed to a proper place. SECTION 6. Penalty. Any person violating any prevision of this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not ex- ceeding $50.00, or by imprisonment in the County Jail not exceeding thirty (30) _ days, or by both such fineandimprisonment. SECTION 7. Camino Capistrano - Angle Parking Required. Angle parking is hereby established on both sides of the street within the area of the City known as Camino Capistrano located in the business section of said City, between Ortega Highway and the intersection with Forster Street. All vehicles when parked in the angle parking spaces designated shall stand at an angle of approximately 450 to the curb with the front of such vehicles toward the curb and with the right front wheel of such vehicles not farther than six (6) inches distant from the curb line. The Director of Public Works and/or the City Engineer of said city shall 315 cause said angle parking spaces to be appropriately designated. SECTION 8. Ortega Highway - Angle Parking Required. Angle parking is hereby established on both sides of Ortega Highway between Camino Capistrano and E1 Camino Real. All vehicles when parked in the angle park- ing spaces designated shall stand at an angle of approximately 450,to the curb with the front of such vehicles toward the curb and with the right front wheel of such vehicles not farther than six (6) inches distant from the curb line. The Director of Public Works and/or the City Engineer of said city shall cause said angle parking spaces to be appropriately designated. SECTION 9. Camino Capistrano - Parallel Parking Required. Parallel parking is hereby established on both sides of Camino Capistrano beginning at the intersection of Ortega Highway northerly to the intersection with LaZanya Street. All vehicles when parked.parallel shall stand at no greater distance than eighteen inches (18") from any such curb that might be existing. Also, the section of Camino Capistrano from the intersection of Forster Street southerly to the intersection with Avenida Padre shall be required to have para- llel parking. All vehicles when parked in a parallel position shall stand at no greater distance than eighteen inches (18") from any existing curb thereon. SECTION 10. Parking on other streets not specifically designated. As provided in the California Vehicle Code, Section 22502 "except as other- wise provided in this chapter, every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be stopped or .parked with the sight hand wheels of such vehicle parallel with and within eighteen inches (18") of the right hand curb. Where no curbs or barriers bound any roadway, right hand para- llel parking is required unless otherwise indicated. This Section does not apply to commercial vehicle when loading or unloading merchandise or passengers." ARTICLE III. SPEED LIMITS. SECTION 1. Speed limits established. On the basis of engineering and traffic surveys, the City Council of the City of San Juan Capistrano, County of Orange, State of California, pursuant to Sections 22357 and 22358 of the Vehicle Code of the State of California hereby establishes the prima facie speedlimits upon those streets and highways in the incorporated area of said City of San Juan Capistrano as indicated in this Art- icle. SECTION 2. Camino Capistrano. Camino Capistrano between Avenida Paloma and LaZanya Street, the prima facie 316 speed limit is 25 miles per hour. SECTION 3. Camino Capistrano. Camino Capistrano from the intersection of LaZanya Street to Oso Road, the prima facie speed limit is 35 miles per hour. SECTION 4. Camino Capistrano. Camino Capistrano from Avenida Paloma to just south of the off -ramp of the San Diego Freeway being southerly of San Juan Creek Road, the prima facie speed shall be 35 miles per hour. SECTION 5. Camino Capistrano. Camino Capistrano, just south of the off -ramp which is just southerly of the San Juan Creek Road to the southerly city limits, the prima facie speed limit shall be 55 miles per hour. SECTION 6. Camino Capistrano. Camino Capistrano from Oso Road to the northerly city limits, the prima facie speed limit is 55 miles per tour. SECTION 7. Del Obispo Street. Del Obispo Street from Camino Capistrano westerly and southerly to Camino del Avion, the prima facie speed limit is 35 miles per hour. SECTION 8. Ortega Highway. Ortega Highway between Camino Capistrano and the San Diego Freeway, the prima facie speed limit is 25 miles per hour. SECTION 9. Posting Signs. The Director of Public Works and/or the City Engineer of the said City of San Juan Capistrano shall erect appropriate signs on the streets and highways set forth in this Article, inconformity with Section 21403 of the Vehicle Code of the State of California, giving notice of the prima facie speed limits estab- lished. ARTICLE IV. STOP INTERSECTIONS. SECTION 1. Through streets or highways defined. All major, primary and secondary highways of the City of San Juan Capistrano as shown on the Master Plan of Arterial Streets and Highways adopted by resolution of the City Council on the 9th day of July, 1962, as the same may have been or may be amended and on file in the office of the City Clerk are hereby declared to be through highways together with such other highways as the City Council may by resolution from time to time declare to be through streets or highways. SECTION 2. Stop intersections designated. 31'7 The City Council may, from time to time, by resolution designate and declare specific intersections to be stop intersections. SECTION 3. Stop signs. The Director of Public Works and/or the City Engineer is authorized to erect and maintain stop signs conforming to the requirements of Section 21400 of the Vehicle Code of the State of California at such entrances to any and all of said streets or highways and stop intersections as in his opinion are reasonably nec- essary for the protection and safety of the traveling public. SECTION 4. Vehicles to stop. The driver of any vehicle upon approaching on any entrance of any through street or highway or intersection sign posted with a stop sign as herein provided shall stop at the limit line if marked, otherwise before entering the crosswalk on the nearside of the intersection or if none, then before entering the inter. section. SECTION 5. Penalty. Any person who shall violate any of the provisions of this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not to exceed fifty dollars ($50.00) or by imprisonment in the County Jail for a period of not to exceed ten (10) days, or by both such fine and im. prisonment. ARTICLE V. WEIGHT .LIMITS. SECTION 1. Five ton gross weight. It shall be unlawful for any person, firm or corporation to drive or operate or cause to be driven or operated upon or across the following bridges, highways, rights -o£ -way, any vehicle where the combined load of such vehicle is greater than five (5) tons gross weight. (a) Bridges. Granada Drive bridge over the San Juan Creek lying between Ortega Highway and the intersection with San Juan Creek Road. SECTION 2. Loads exceeding the maximum. (a) Permit. In accordance with Sections 35780 through 35784, Vehicle Code, State of California, upon an application in writing and if the applicant shows good cause, the Director of Public Works and/or the City Engineer may in his discretion issue a permit in writing authorizing the operation upon city streets and highways of a vehicle or combination of vehicles, the size 318 or weight or load which exceeds the maximum specified in the Vehicle Code, Divi- sion 15, Chapter 5. The permit may be for such lengths of time up to a period of three months and for such number of operations limited or unlimited as the Director of Public Works and/or the City Engineer may deem advisable. (b) Permit fee. The fee for each permit issued under the provisions of this Section shall be two dollars ($2.00) per vehicle or combination of vehicles except however, the fee for a permit for a three month period shall be twenty five dollars ($25.00) -, per vehicle or combination of vehicles. (c) Security may be required. The Director of Public Works and/or the City Engineer may require such undertaking or security as may be deemed necessary to protect the streets and highways and bridges from injury or to provide indemnity for any injury re- sulting from the operation as provided in Section 35782 of the Vehicle Code. SECTION 4. Regulations for moving buildings or structures. (a) Man -power minimum. It shall be unlawful for any building or structure twenty (20) feet or more in width to be moved over„ upon' along or across any street or high- way, alley or way unless the contractor so moving the same shall have not less than five (5) men engaged in said moving operations comprised as follows: (1) a foreman, (2) a truck driver, (3) a man on the building to handle wire clearances, (4 and 5) two flag men, one to be at least 300 feet ahead of the building or struc- ture, the other flagman shall follow said building or structure at a distance suf- ficient to give adequate warning to approaching traffic. Said flagmen shall carry the signals required by law. (b) Relocation permit required. When any building is to be moved, the permit shall not be issued unless a relocatioA permit has been applied for, approved, and issued. ARTICLE VI. ENFORCEMENT. SECTION 1. Penalty. Any person who shall violate any of the provisions of this Article shall be deemed guilty of a misdemeanor and upon convection thereof shall be punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment in the County Jail for a period not to exceed thirty (30) days or by both such fine and imprisonment. SECTION 2. Repeal. 319 Ordinance No. 32, an Ordinance entitled: "An Ordinance of the City of San Juan Capistrano regulating the parking of motor vehicles within the city limits of the City of San Juan Capistrano; providing penalties for the violation thereof" is hereby repealed. SECTION 3. This ordinance shall take effect and be in force thirty (30) days from and after its passage and prior to the expiration of fifteen (15) days after the pass- age thereof, this ordinance shall be published once in the Coastline Dispatch, a newspaper printed in San Juan Capistrano, County of Orange, State of California, together with the names of the members of the City Council.
