ORDINANCE NO. 71
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SAN JUAN CAPISTRANO PROVIDING
FOR THE COMPENSATION OF CITY OFFICERS
AND EMPLOYEES IN THE VARIOUS AND SEVERAL
OFFICES OF THE CITY.
The City Council of the City of San Juan Capistrano, also acting as the Board
of Directors for the Municipal Sewer District, does ordain as follows:
SECTION L. TITLE AND DEFINITIONS
This ordinance shall be known and may be cited as "The Salary Ordinance of
San Juan Capistrano."
Words used in the present tense include the future, except where the natural
construction of this ordinance otherwise indicates. Words in the singular number
include the plural,, and words in the plural number include the singular; and the
word "shall" is mandatory and not directory.
"City Officers" shall mean those certain officers designated in Section 36501
of the Government Code of the State of California as now enacted, or as later may
be amended.
"Department Heads" shall mean those persons not "City Officers" who axe ap-
pointed or employed by the City Council or otherwise as the principal employee of
a department or district for the discharge of duties provided by law or particular
delegated functions.
"District" shall mean any special district that may be established, formed,
or existing within the corporate limits of a sixth class, general law city.
"Employees" shall mean all persons employed by the City of San Juan Capistrano
or districts, other than "City Officers" except where the natural construction of
this ordinance otherwise indicates.
"Regular Full Time Position" shall mean a position established on a permanent
year round basis r4quiring work on a regular schedule of at least forty (40) hours
per week and being compensated at a monthly rate.
"Regular Full Time Employee" shall mean a person employed in a regular full
time position.
"Regular Part Time Position" shall mean a position established on a permanent
year around basis requiring work on a regular schedule of less than forty (40) hours
per week and being compensated at a monthly rate.
"Regular Part Time Employee" shall mean a person employed in a regular part
time position.

"Regular Employee" shall include both "Regular Full Time Employees" and ..Reg-
ular Part Time Employees".
"Extra Help Position" shall mean a position intended to be occupied on less
than a year round basis to cover seasonal peak work loads, emergency extra work
loads of limited duration, necessary vacation relief and other situations involving
a fluctuating staff. Employees in extra help positions shall be compensated at a
daily rate.
"Extra Help Employee" shall mean a person employed in an extra help position.
SECTION 2. COMPENSATION SCHEDULE ,
Except as by this ordinance otherwise provided, officers, and employees shall
receive the compensation provided in the basic salary schedule hereinafter set forth
for the classification of position in which they are employed, in accordance with
the allocation of such classifications (also hereinafter set forth) to ranges of
the basic salary schedule, and in accordance with the terms of employment hereinafter
set forth.
SECTION 3. BASIC SALARY SCHEDULE
Following are the ranges of monthly salaries in dollars for regular full time
employees.

SECTION 6. PAY FOR REGULAR PART TIME EMPLOYEES
A regular part time employee shall be paid a monthly salary which bears the
same relationship to the rate he woule receive if he were a regular full time em-
ployee as the number of hours per week in his part time work schedule bears to the
number of hours per week he would work if he were a regular full time employee.
SECTION 7. PAY FOR EXTRA HELP EMPLOYEES
Extra help employees shall be paid the daily rate in Section 4 of this ordi-
nance corresponding to the first step of the monthly salary range for the partic-
ular class, unless otherwise specified by resolution or minute order of the City
Council as specified in Section 4 of this ordinance.
SECTION 8. PARTIAL MONTH'S PAY FOR REGULAR EMPLOYEES
When a regular employee is entitled to receive less than his full month's pay,
the partial month's pay shall be computed as follows:
If the employee is entitled to pay for ten (10) full working days or less, he
shall receive the daily equivalent of his monthly salary as shown in Section 4 of
this ordinance for each day for which pay is authorized.
I£ the employee is entitled to pay for eleven (11)full working days or more, the
daily equivalent of his monthly salary as shown in Section 4 of this ordinance shall
be deducted from his Hill monthly salary for each regular working day for which pay
is not authorized. For purposes of this section "regular working day" shall refer
to those days in the particular month which would have been worked by the particular
employee if he had worked his full time regular schedule.
SECTION 9. MILEAGE ALLOWANCE
Every City Officer or employee who is required to use a private automobile
in the discharge of service for the city, shall after having the approval of the
City Council receive compensation for the use of such automobile at the rate of
ten cents per mile, or at such rate as may be set by resolution of the City Coun-
cil.
SECTION 10. ADDITIONAL COMPENSATION
Notwithstanding anything in this ordinance to the contrary, when in the judge-
ment of the City Council, it becomes necessary or desirable to utilize the services
of the city employees in capacities other than those for which they aro regularly
employed, the City Council may, by minute order, so authorize and fix an additional
rate of compensation for such employees who shall be paid such additional compen-
sation upon claims presented and approved in like manner as other claims against
the city are presented above.
SECTION 11. EMERGENCY EMPLOYMENT
Should it become necessary for a department to employ a person in a type of
position for which there is no classification provided in this ordinance, the City
Council may authorize such employment at a salary to be determined by minute order
of said Council. Such minute order shall stipulate whether the particular position
is to be considered as a regular full time position, regular part time position or
extra help position for purposes of this ordinance and other ordinances governing
employees. -
SECTION 12.
If any paragraph, sentence, clause, or phrase of this ordinance for any reason
is held to be unconstitutional or invalid, such shall not affect the remaining por-
tion of this ordinance, and the City Council hereby declares it would have passed
each paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more than one paragraph, sentence, clause, or phrase be declared uncon-
stitutional or invalid.
SECTION 13.
This ordinance shall take effect and be in force on July 1, 1963, and prior
to the expiration of fifteen (15) days after the passage thereof, this ordinance
shall be published once in the Coastline Dispatch, a newspaper printed in the City
of San Juan Capistrano, County of Orange, State of California, together with the
names of the members of the City Council voting for and against the same.
