ORDINANCE NO. 62
AN ORDINANCE OF THE CITY OF SAN JUAN j
CAPISTRANO PROHIBITING THE DUMPING OR
OTHERWISE PLACING, PUTTING, OR DISPOS-
ING OF ANY TRASH, REFUSE, VEGETABLE
TRIMMINGS OR RUBBISH UPON PRIVATE OR
PUBLIC PROPERTIES.
The City Council of the City of San Juan Capistrano does ordain
as follows:
SECTION 1. Short Title. This Ordinance shall be known as and may
be cited as "The City of San Juan Capistrano Anti -Litter Ordinance".
SECTION 2. Definitions. For the purpose of this Ordinance the
following terms, phrases, words and their derivations shall have the
meaning given herein.
(1) "Garbage" is putrescible animal and tegetable waste re.
sulting from the handling, preparation, cooking and consuming of food.
(2) "Litter" is "garbage'I "refuse", "rubbish" and "trash"
as herein defined is herein prohibited, tends to create a danger to
public health, safety and welfare.
(3) "Person" is any person, firm, partnership, association,
or corporation, company or organization of any kind.
(4) "Private Premises" is any dwelling wholly or in part for
private residential or commercial purposes, whether inhibited or tempor-
arily or continuously uninhabited or vacant and shall incude any yard,
ground, walk, driveway, porch, steps, vestibule or.mailbox belonging or
appurtenant to such dwellings, house, buildings or other structure.
(5) "Public Place" is any and all streets, sidewalks, boul-
evards, alleys or other public ways and any and all public parks, schools,
squares, spaces, grounds and buildings.
(6) "Refuse" is nonputrescible solid wastes consisting of
zoo
both combustible and non-combustible wastes, such as papers, wrappings,
cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass,
bottles, beddings, crockery, and similar materials.
SECTION 3. Litter onto Public Places. No person shall throw or
deposit litter in or upon any street, sidewalk or other public place
within the City except in public receptacles, in adequate, private re-
ceptacles for collection, or in official City or County dumps.
SECTION 4. Placement of Litter in Receptacles So As To Prevent
Scattering. Persons placing litter in public receptacles or in adequate
private receptacles for collection shall do so in such a manner as to
prevent it from being carried or deposited by the elements upon any st-
reet, sidewalk or other public place or upon private property.
SECTION $. Litter on Occupied Private Property. No person shall
throw, dump, place or deposit litter on any occupied private property
within the City, whether owned by such person or not, except that the
owner or person in control of private property may maintain adequate
private receptacles for collection in such a manner that litter will be
prevented from being carried or deposited by the elements -upon any
street, sidewalk or other public place or upon private property, pro-
vided however, nothing in this section shall prevent the reasonable
storage on private property of yard, tree and shrub trimmings for a
temporary period pending collection or other authorized disposal thereof.
SECTION 6. Placing trash, rubbish, gargage that may decay on land
of another :prohibited. No person shall place or deposit upon the land
of another any tin cans, trash, refuse, rubbish, garbage, offal, nause-
ons substance, tree trimmings, grass cuttings, animal or Vegetable matter,
mulch or any material which may become decayed or putrid, except however
that tulstsection shall not prohibit the placement of vegetable matter �
as provided in Section %.
SECTION 7. Spreading of Vegetable Trimmings. Nothing herein con-
tained shall be construed to prohibit the spreading of vegetable trimm-
ings upon private property within the City from vegetables grown on said
property; provided that such vegetable trimmings shall be spread upon
the property in a continuous layer and plowed or disced under the surface
of the ground no later than six (6) days from and after the day of spread-

ing the same. No vegetable trimmings shall be spread upon any property
upon which vegetable trimmings have been spread within the preceding
three (3) months.
SECTION 8. Penalties. Any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and upon con-
viction thereof shall be fined in an amount not exceeding Five Hundred
Dollars ($500.00) or be imprisoned in the County Jail for a period not
exceeding six (6) months or be both so fined and imprisoned. Each day
such violation is committed shall constitute a separate offense and shall
be punishable as setforth herein above.
SECTION 9. The Clerk of the Council shall certify to the passage
of this Ordinance and shall cause the same to be published in the Coast-
line Dispatch after its adoption. This ordinance shall take effect thirty
(30) days from and after the date of its final adoption.
PASSED AND ADOPTED by the City Council of the City of San Juan Cap-
istrano at its regular meeting held on the 14th day of January, 1963.
