CITY OF SAN JUAN CAPISTRANO ESTABLISH_ .
ING DISTRICT REGULATIONS COVERING E-4
"HILLSIDE ESTATES", WITHIN THE CITY OF
SAN JUAN CAPISTRANO BY AMMF,NDING CITY
ORDINANCE NO. 5 BY ADDING THERETO
SECTION J TO SECTION 3 THEREOF.
The City Council of the City of San Juan Capistrano does ordain as
Follows:
SECTION 1. That to nromote the general welfare and classify, regul-
ate, restrict and seperate the use of land, buildings and structures in
providing for the orderly growth of the City of San Juan Capistrano, there
is hereby established the following land use district within the City of
San Juan Capistrano.
E-4 HILLSIDE
ESTATE DISTRICT.
SECTION 2. To provide for District regulations covering the dist-
rict set forth in Section 1 of this Ordinance, Section 3 of Ordinance No.
5 is hereby amended by adding section J thereto as follows:
SECTION J _ "E_4 HILLSIDE ESTATE DISTRICT REGULATIONS"
USES PERMITTED.
1. Farming, including all types of agriculture and horticulture.
EXCEPT
a. Commercial dairies.
b. Commercial kennels, rabbit, fox goat and other animal raising
farm.
c. Egg producing ranches and farms devoted to the hatching, raising
fattening and or butchering of chickens, pigeons, turkeys and other poult-
ry on a commercial scale.
d. Hog and livestock feeding ranches.

e. Ranches operated publicly or privately for the disposal of garb-
age, sewage, :. bbish or offal.
2. Public Parks,
3. One family dwellings of a permanent character placed in a perm-
ent location on a lot of record.
4. Home occupations, such as offices and studios when conducted with-
in the building by the occupant thereof, provided no advertising signs
merchandise or other material or equipment is displayed for advertising -.
purposes.
5. One (1) unlighted sign not exceeding six (6) square feet in area
pertaining only to the sale, lease or hire of only the particular build-
ing, property or premises upon which displayed. No other advertising
sign, structure or device of any character shall be permitted within this
district.
6. The following additional uses may be permitted subject to issue
of an approved Land Use Variance.
A. Electrical distributing substation gas metering and regul-
ating stations and similar public utility structures rendering direct
service to the public in said local area.
B. Golf courses.
C. Schools and Colleges.
7. Site requirements
a. The minimum building site area for each one family dwelling shall
be ten thousand square feet.
b. The minimum street frontage width shall be 90 feet.
c. The building height limit shall be two stories and not to exceed
35 feet.
d. 04f street parking consisting of one cohered, raved, usable car
storage area, not less than 20 x 22 feet each shall be provided for each
dwelling unit on the site.
e. Concrete curbs and gutters are required along the property line
facing the street. Sidewalks may or may not be rewired at the discret-
ion of the Director of Public Works.
f. The following setbacks shall be. considered a minimum requirement.
1. Front yards - 25 feet from the street line.

2. Side yards - l0feet from property or street line.
3. Rear yards - 29 feet from property line.
4. In the event the property line extends into the street area
reference must be made to the requirements of the City Master Street plan
as it refers to front and side yard set backs.
g. Detached garages shall not be permitted closer than six (6) feet
from the main building on the same or adjacent lot.
h. GRADING & FILLING. Where building site is located in or on a
hillside area where grading or filling is required for site preparation
such grading or filling shall conform to City Ordinance"specifying the
requirements for such site preparation.
SECTION 3, The City Clerk shall certify to the passage and adopt-
ing of this Ordinance by the City Council of the City of San Juan Capis-
trano at a regular meeting held on the 27th day of August, 1962, and
shall cause the same to be published in the Coastline Dispatch within
fifteen days after its passage.

ORDINANCE NO. 56
AN ORDINANCE OF -..TRE CITY OF SAN JUAN CAPISTRANO
ESTABLISHING RULES, REGULATIONS AND SPECIFICAT-
IONS TO CONTROL AND REGULATE THE DIVISION OF
LAND WITHIN THE CITY OF SAN JUAN CAPISTRANO AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
ARTICLE I
GENERAL PROVISIONS
SECTION 1.01 PURPOSE. The purpose of this chapter, and any rules,
regulations and specifications adopted pursuant thereto, is to control
and regulate the division of land within the City of San Juan Capistrano
and such land as may be annexed to said City.
SECTION 1.02 AUTHORITY FOR LOCAL REGULATIONS. Pursuant to the provis-
ions of Chapter 2, Part 2 of Division 4 of the Business and Professions
Code, State of California, referred to herein, as the Subdivision Map
and in addition to any regulations provided by law, the regulations here-
inafter in this ordinance contained shall apply to all subdivision, parts,
of subdivisions her=after made, entirely or partically within the CITY
OF SAN JUAN CAPISTRANO and this ordinance shall be known as The Subdivis-
ion Ordinance.
SECTION 1.03 ADVISORY AGENCY. The Planning Commission, as herein de-
fined, is hereby designated as be Advisory Agency as that term is used
in the Subdivision Map Act and is charged with the duty of making invest-
igations on design and improvement of proposed subdivisions and is here-
by authorized to approve,conditionally approve or disapprove tentative
maps of subdivisions prepared and filed according to this ordinance and
the Subdivision Map Act and to specify the kinds, nature and extent of
improvements to be installed in Subdivisions.
ARTICLE II
DEFINITIONS
SECTION 2.01 DEFINITIONS IN ACT. Except as otherwise provided in this
