ORDINANCE NO. 46
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND
GIVING NOTICE OF "A SPECIAL ELECTION TO BE HELD
IN SAN JUAN CAPISTRANO MUNICIPAL SEWER DISTRICT
NO. 1 ON THE 3RD DAY OF APRIL, 1962, FOR THE .
PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS
OF SAID DISTRICT A PROPOSITION TO INCUR BONDED
INDEBTEDNESS BY SAID DISTRICT FOR A CERTAIN
IMPROVEMENT.
WHEREAS, the City Council of the City of San Juan Capistrano, Cal-
ifornia did on the 13th day of February, 1962, by a vote of two-thirds
of the members of said City Council, adopt Resolution No. 62-2-13-5,
entitled "Resolution of the City Council of the City of San Juan Capis-
trano -finding that public interest requires the formation,of the San
Juan 6apistrans Municipal Sewer District No. 1 and fixing and determin-
ing the bohndaries thereof", which said resolution was duly signed and
approved by the Mayor of said city and attested and certified by the
City Clerk of said city;
NOW, THEREFORE, the City Council of the City of San Juan Capistrano,
California, DOES ORDAIN as follows:
Section 1. That a special election be held, and the same is hereby
called to be held in San Juan Capistrano Municipal Sewer District No. 1
on the 3rd day of April, 1962, for the purpose of submitting to the

qualified voters of said district a proposition of incurring indebtness
and issuing bonds of said district therefor, in the amount hereinafter
set forth, and for the object and purpose set forth in said resolution
and hereinafter stated.
Section 2. That the territorial district upon which the expense
of the improvement shall be chargeable is the San Juan Capistrano Muni-
cipal Sewer District No. 1 established by this City Council on February
13, 1962, by Resolution No. 62-2-13-5. The exterior boundaries of said
district are set forth in said resolution.
Section 3. That the object and purpose for which Laid indebtedness
is to be incurred and the bonds: -issued therefor is as follows:
The acquisition and construction of
improvements to the sewerage facili-
ties in part of the territory of said
city, including the acquisition of land
rights of way and other property neces-
sary therefor.
Section 4. That the estimated cost of said improvement is the sum
of $101,000 and that the amount of the principal of the indebtedness to
be incurred there for is the sem of $75,000. The estimated cost of said
improvement includes any or all of the following (a) all costs and esti-
mated costs incidental to or connected with the acquisition, construct-
ion and financing of the improvement, and (b) all engineering, inspect-
ion, legal and fiscal agent's fees, costs of the.bond election and of
the issuance of the bonds, bond reserve funds and working capital and
bond interest estimated to accrue during the construction period and
for a period of not to exceed twelve months after completion of constr-
uction.
Section 5. That the maximum rate of interest to be paid on said
indebtedness shall not exceed the maximum rate permitted by law, to wit,
six per cent (6,9) per annum, payable annually theSfirst year and semia-
nnually thereafter, the actual rate or rates of interest on said bonds
to be determined at or prior to the time of the sales or sales thereof.
Section 6. That if the proposition for the incurring of bonded
indebtedness so submitted receives the requisite number of votes, to

wit, two-thirds of the votes of the qualified electors of said district
voting on said proposition, bonds of said district, in not exceeding
the principal amount stated in such proposition, shall be issued and
sold for the object and purpose s9t forth in said proposition.
Section 7. That the polls for said election shall be opened at
seven o'clock, A. M., of the day of said election and shall remain open
continuously from said time until seven o'clock, P. M., of the same day,
when said polls shall be closed, except, as provided in Section 14436 of
the Elections Code of the State of California.
Section 8. That on the ballots to be used at said special election
in addition to any other matters required by law, there shall be printed
substantially the following:
MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP NEVER WITH PEN
OR PENCIL.
(ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL)
INSTRUCTIONS TO VOTERS
To Vote on any measure, stamp a cross (+) in
the voting square after the word "YES" or after
the word "NO". All marks, except the cross (+)
are forbidden. All distinquishing marks or
erasurers are forbidden and make the ballet void.
If you wrongly stamp, tearor deface this ballot,
return it to the inspector of election and obtain
another.
On absent voters ballots mark a cross (+) with pen
or pencil.
Y BOND PROPOSITION: Shall the City of San Juan
Capistrano incur a bonded indebtedness for San Juan
Capistrano Municipal Sewer District No. 1 in the YES
principal sum of $75.000 for the acquisition and
construction of improvements to the sewerage fac-
ilities for the benefit of the lands and inhabit. .NO
ants within said municipal sewer distriet.includ-
ing the acquisition of land, rights of way and

other property necessary therefor?
Section 9. A cross (+) placed in the voting square after the
word "YES" in the manner hereinbefore provided shall be counted in
favor of the adoption of the question or proposition. A cross (+)
placed in the voting square after the word "NO" in the manner herein-
before provided shall be counted against the adoption of the question
or proposition.
Section 10. That for the purpose of holding said special election
.all of the territory within said district shall comprise one voting pr-
ecinct, which shall be designated Consolidated Voting Precinct 1. The
polling place for said precinct shall be the place hereinafter designa-
ted,%and the persons hereinafter named, being competent and qualified
electors and residents of said district and of said election precinct,
are hereby appointed officers of election and they shall hold said el-
ection and make return thereof in the manner provided by law.

Sectionll. That except as otherwise provided in this ordinance,
the election called hereby shall be conducted as provided by law for
municipal elections in the City of San Juan Capistrano.
Section 12. That the City Council of said city shall meet at its
usual place of meeting in the City Council Chambers on Tuesday, the 10th
day of April, 1962, at 7:30 o'clock P.M. of said day and proceed to can-

vass the election returns and declare the result of said election.
Section 13. That the City Clerk shall certify to the passage and
adoption of this ordinance by a vote of two-thirds.of all of the members
of the City Council of said city, and shall cause this ordinance to be
published once a week for two (2) successive weeks in the COASTLINE DIB
SPATCH, a newspaper of general circulation printed and published less
than six (6) days a week in said city. No other notice of such election
need be given. -
Section 14, This ordinance shall take effect upon its adoption.
