SEAL ) City Clerk of the City of San Juan Capistrano, California ORDINANCE N0. 39 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO ESTABLISHING DISTRICT REGULATIONS COVERING C-1 "LOCAL BUSINESS" AND:C-2 "GENERAL_BUSINESS"..WI- T'HIN THE "CITT'OF SANJUANCAPISTRANO, AND ADOP- TING SECTIONAL CITY MAP:DEFINING THE .BOUNDARIES OF THE C-1 "LOCAL BUSINESS DISTRICT". The City Council of the City of San Juan Oapistrano does ordain as follows: 1. That to promote the general welfare and classify, regulate, r restrict and separate the use of land, buildings and structures in providing for the orderly growth of the city of San Juan Capistrano City Ordinance No. j is hereby amended by adding thereto SUBSECTION NO. 3; as set forth below, and establishing District Regulations go- verning "Local Business" C-1 Zone and "General Business" C-2 Zone. 2. The boundaries of the C-1 "Local Business" District as shown on Section Map of the City of San Juan Capistrano, (Exhibit "A") are hereby approved and adopted. 141 SECTION N0. 3 E. C-1 "LOCAL BUSINESS" District Regulations USES PERMITTED. (a) All uses permitted in R-1, R-2 Districts (PROPOSED). (b) Art Studios Banks Barber Shops Bakeries, retail Beauty Parlor Business Offices Bowling Alleys Catering Establishments Cleaning and Dyeing agencies Clothes pressing Dressmaking and Millinery of retail nature only Employment agencies Florists Hotel and Motels Locksmiths Lodging Houses News Stands Pawn Brokers Photograph Galleries Parking Lots Professional Offices Resturants Service Stations Shoe Repair Shops Sign Shops Sign and advertising structures approved by City Ordinance No. 34 Tailor Shops Telegraph Offices Telephone Exchanges 143 Theatres Utility Offices Coin Operated Laundromats RETAIL .STORES selling: Antiques and Curios Art Goods Auto Supplies Bicycles Books Clothing Ceramics Household goods and furnishings Church Supplies Bird and House animals Drugs Dry Goods Electric Supplies and appliances Food Furniture Hardware Jewelry Leather goods Liquor Musical supplies and instruments Notions and novelties Office supplies and equipment Paint and wallpaper -- porting goods Shoes Surgical supplies and equipment Stationery Soft Drinks Tobacco (c) The following may be permitted subject to approved usage variance: Auto and Trailer Courts constructed in accordance with City Ordinance 143 No. 10. Clearing establishments subject to the following additional conditions: a. All activities other than automobile parking, are conducted wholly within building. b. Not more than 5• persons are engaged in operations exclusive of those engaging in pressing, office or delivery. C. No cleaning fluid is used which is explosive or infammable at a temperature below 138.5 degrees Fahrenheit. d. That not more than 2 clothes cleaning units A.11 be in such establishment, neither of which shall have a rated capacity of more than 40 pounds e. Shall, subject to the approval of the Building Inspector have exhaust of steam or vapor from operation of presses and equip- ment so muffled and vented as to prevent annoyance to occupants of nearby premises or buildings. (d) BUILDING HEIGHTS LIMITS: Building shall be limited to two (2) stories and not to exceed thirty-five (35) feet in height. (e) BUILDING SITE RErUIRED. Except as otherwise provided by City Ordinance, a minimum building site for dwelling purposes shall be seventy-two (?2) hundred square feet. Front and side yards shall be as required by City Ordinance. (f) OFF STREET PARKING or GARAGES: a. Each COMMERCIAL USE unless otherwise provided shall provide and maintain one usable automobile parking space on the pr- emises or at location approved by the Planning Commission, for each three -hundred fifty (350) square feet of floor sp- ace used for commercial purpose. b. Each church, restuaratt„ auditorium, theater, sporting or a,,3etie arena and other similar USES WHERE PEOPLE CONGREGATE shall provide and maintain on the premises or at a location approved by the Planning Commission, automobile parking sp- aces for each three (3) persons such enterprise or use can accommodate. c. Each multiple use dwelling shall provide one usable automobile 144 parking space not smaller than ten (10) feet by twenty (20) feet for each family unit or apartment, provided however, that such automobile parking space capacity for hotels need not exceed one-half (z) of the number of guest rooms. SECTION F. "C-2" GENERAL BUSINESS District Regulations. USES PERMITTED: Unless otherwise provided by City Ordinance, or regulated by Condit- ionallor-Variance Permit requirements, the following businesses are per- -. mitted: (a) All uses permitted in RHE, E-4, R-1, R-2, R-4 Zones (Proposed) and C-1 Districts and under least restrictive provisions of such District unless otherwise provided in this Section. (b) The following general or wholesale types of business: Accessory Uses and Buildings Auction Rooms Auto sales lots for new and used cars Auto Display Rooms Amusement Resorts Auto Repair and Storage Garages Auto Laundries Arcades and similar uses Bakeries, wholesale Boat Sales, retail Body works Bottling Works 'Building Materials Ceramics Manufacturing providing entire operation is enclosed under ro6f. Confectioner's - Supplies Cleaning Establishments Dancing in connection with a cafe, provided aE:ea of dance floor does not accommodate more than the seating capacity of such cafe. Dyeing Works Electric Supplies Fountain Supplies 145 Fuel and Feed Yards Glass Shops Greenhouses for display and sale of plants, flowers, shrubs, Nurseries. Laundries Lumber Yards without Planning Mills. Machinery Sales Rooms Mattress Factories Newspaper Publishing Painting and Decorating Shoos Plumbing Shops ) Printing and Bookbinding Establishments Roofing Establishments Saddle and Leather Goods Factories Shooting galleries and similar uses. Sign and Advertising Structures as approved by City Ordinance No. 34 Skating Rinks Storage warehouses Tire and Battery Shops Transfer Businesses Undertaking Establishments and Mortuaries Upholstery Shops Veterinary hospital, provided entire operation is enclosed in a sound proofed building. (c) The following may be permitted with ap?roved electric motor power not in excess of an aggregate of five (5) horsepower. (2) Each USE WHERE PEOPLE CONGREGATE such as Churches, Restaurants, Auditoriums, Theaters, Arenas and similar uses shall provide and maintain on the premises, or at a location approved by the Planning Commission,. automobile parking spaces at the ratio of one usuable automobile parking space for each three (3) persons such enterprise or use can accommodate. (3) Each INDUSTRIAL ENTERPRISE shall provide and maintain on the premises or at locations approved by the Planning Commission, one usable automobile parking space for each three (3) persons employed. If Retail Sales are made on the premises, and add- itional amount of parking space shall be provided and mainta- ined on the premises, or at location approved by the Planning Commission, equal to one usable parking space for each three hundred fifty (350) square feet of floor space used for such Retail Sales. (SEAL) City Clerk ORDINANCE NO 40 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO AMENDING SECTION 16 OF ORDINANCE NO. 24 OF THE CITY OF SAN DUAN CAPISTRANO RELATING TO BUSINESS LICENSES. The City Council of the City of San Juan Capistrano does ordain as follows: SECTION 1. Section 16 of Ordinance No. 24 of the City of San Juan Capistrano is hereby amended to read as follows: Section 16. subsection 34 Vending Machines. Every person engaged in managing, conducting or carrying on the business of leasing, letting the use of, renting or maintaining any vending; weighing or merchandise machine or device, not otherwise licensed under this ordinance, and not prohibited by law, where coins are inserted of less than 5 cents in va- lue shall pay an annual license of $1.00 for each such machine or device; where coins of value of 5 cents and less than 10 cents are inserted, an
