ORDINANCE NO. 38
AN ORDINANCE OF THE CITY OF SAN JUAN
CAPISTRANO ESTABLISHING PENALTIES FOR
THE VIOLATIONS OF ITS ORDINANCES, AND
DECLARING THE URGENCY THEREOF.
The City Council of the City of San Juan Capistrano does ordain
as follows:
SECTION 1. In the enactment of some of the earlier uegency ordin-
ance of the City of San Juan Capistrano the penalty clauses have, through
inadvertance, been omitted, thereby gravely interfering with the local
enforcement agencies in dealing with those who violate the terms and
conditions of such ordinances. It is the purpose of th�s ordinance to
establish uniform penalties for the violation of any ordinance of the
City of San Juan Capistrano, except where a different oenalty may be
sent forth.
SECTION 2. Any person violating any of the provisions of any ord-
inance heretofor or hereafter enacted by the City Council of the City
of San Juan Capistrano, except where the ordinance violated prescribes
a different penalty, shall be guilty of a misdemeanor or and shall be
punished by a fine not to exceed $500.00 or by imprisonment in the Co-
unty Jail for a period not to exceed six months, or by both such fine
and imprisonment.
SECTION 3. Pursuant to the provisions of section 36937 of the Go-
vernment Code of the State of California, this ordinance shall take eff-
ect immediately for the following reasons:
At the present time there are certain ordinance, of the City of San
Juan Capistrano which are unenforcable because of the inadvertant comm-
ission therefrom at the time of adoptionnof any penalty clause. This,
in some instance, renders such ordinance unenforcable and without such
ordinance in full force and effect the administration of the affairs of
the city is greatly hampered.
SECTION 4. The City Clerk shall certify to the passage and adoption
of this ordinance by the City Council of the City of San Juan Capistrano,
at a regular meeting held on the 23rd day of October, 1961 and shall cause
the same to be published in the Coastline Dispatch within fifteen days
after its passage. .

ESTABLISHING DISTRICTf REGULATIONS COVERING C-1
"LOCAL BUSINESS" AND C-2 "GENERAL,BUSINESSr.b1I-
THIN THE--CITY'OF SAN: JUAN CAPISTRANO, AND -ADOP-
TING SECTIONAL CITY MAP,DEFINING THE BOUNDARIES
OF THE C-1 'LOCAL BUSINESS DISTRICT".
The City Council of the City of San Juan Oapistrano does ordain
as follows:
1. That to promote the general welfare and classify, regulate,
restrict and separate the use of land, buildings and structures in
providing for the orderly growth of the city of San Juan Capistrano
City Ordinance No. 5 is hereby amended by adding thereto SUBSECTION
NO. 3; as set forth below, and establishing District Regulations go-
verning "Local Business" C-1 Zone and "General Business" C-2 Zone.
2. The boundaries of the C-1 "Local Business" District as shown
on Section Map of the City of San Juan Capistrano, (Exhibit "A") are
hereby approved and adopted.
