(SEAL) AYES: Councilmen: Bathgate, Chermak, Durnford, Olivares, Buchheim NOES: Councilmen: None ABSENT: Councilmen: None City Clerk Pro Tem ORDINANCE NO. 1$ AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, IMPOSING A CUREW ON MINORS AND PROVIDING FOR PENALTIES AND THE URGENCY THEREOF. The City Council of the City of San Juan Capistrano does hereby ordain as follows: SECTION 1. No minor under the age of eighteen (18) years shall remain, loiter, stroll, tarry or linger upon or about public streets, alleys, avenues or places open to the general public or in public view between the hours of 9:30 o'clock P.M. and 6:00 A.M. unless such minor is accompanied by a parent, guardian, or other adult person having the legal control and custody of such minor: providing, however, that the prohibitions herein shall not apply to those minors under the age of eighteen (18) years attending an educational gathering orppublic place 33 of entertainment which has been approved and consented to by such parent or guardian, nor to such minors en route to or returning from said plac- es in a direct and expedient manner, nor to such minors necessarily at such places, or en mute to, or returning from said places by reason of their employment, an errand of duty directed by such parent or guardian, or .an emergency situation. SECTION 2. Pursuant to the provisions of section 36937 of the Gov- ernment Code of the State of California, this Ordinance shall take effe- ct immediately for the following reasons: At the present time there are no regulations pro4iting minors un- der the age of eighteen (18) years from doing the acts prohibited by this Ordinance. If this Ordinance does not take effect immediately, such mi- nors will be in danger of becoming involved in serious crimes- and other situations contributing to their delinquency. Also innocent persons may suffer here at the hands of such irresponsible minors. SECTION 3. The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council of the City of San Juan Capistrano at a regular meeting held on the 24th day of Apri1,�,1961 and shall causes the same to be published in the Coastline Dispatch within fifteen days after its passage. AYES: Councilmen: Bathgate, Chermak, 34 Durnford, Olivares, Buchheim NOES: Councilmen: None ASSENT: Councilmen: None City Clerk Pro Tem ORDINANCE NO. 16 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO PROHIBITING INTOXICATION IN CERTAIN PLACES AND PROVIDING FOR PENALTIES AND THE URGENCY THEREOF. The City Council of the City of San Juan Capistrano does hereby ordain as follows: SECTION 1. It 'shall be unlawful for any person to.be or appear on any public street or other public place or any place open to the public view, in the City of .San Juan Capistrano, in a state of intoxication. SECTION 2. It shall be unlawful for any person to be in any private house or any private building or on any private premises in a state of intoxication to the annoyance of any other person in the City of San Juan Capistrano. SECTION 3. It shall be unlawful for any person to be in any autom- obile or other vehicle on a public street or other public place in the City of San Juan Capistrano in a state of intoxication. SECTION 4. It shall be unlawful for any person whilb intoxicated to enter, remain or be in any public dance hall, public dance, club, da- nce, skating rink, or any other place of business open to public patron- age in the City of San Juan Capistrano. SECTION 5. Any person violatingany of the provisions of this ordi- nance shall be guilty of a misdemeanor and shall be punished by a fine not to exohed $500.00, or by imprisonment in the County jail for a period not to exceed six months, or by both such fine and imprisonment. SECTION 6. Pursuant to the provisions of Section 36937 of the Gov- erment Code, this Ordinance shall take effect immediately for the foll- owing reasons: At the present time there are no regulations prohibiting intoxicat- ion under offensive conditions as covered by this Ordinance.
