ORDINANCE NO. 232
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING ORDINANCE NO. 115 AND REPEALING ALL
ORDINANCES IN CONFLICT WITH SAID AMENDMENT.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. That subsection 5.09.3 of Ordinance No. 115 is
rescinded and the following substituted therefor:
5.09.3 NON -CONFORMING SIGNS:
A. Subject to the following provisions, any
sign or advertisingstructure existing at the time of the adoption of
this ordinance and which are in conflict with the provisions of Section
5.09 of Ordinance No. 115, may be so continued and maintained for a
reasonable period of time to amortize the investment therein.
B. All such signs shall be removed or brought
into compliance with this article in accordance with the abatement
schedule set forth below. The abatement periods shown, shall not com-
mence until the effective date of this article.

These abatement periods are based on the
value of the sign as shown on the sign permit when originally issued
or by valuation of the City of San Juan Capistrano in the event that
no value is shown on the original sign permit. In theeventthat the
owner of the sign believes that the value of his sign is greater than -
the sign permit value, he may, within 30 days of the effective date
of this article, present evidence of such value to the Planning
Commission Staff. The Planning Commission shall then rule as to
whether the presented evidence warrants placing said owner's non-
conforming sign into a higher value category. If such higher sign.
value is granted, the new abatement period will correspond to the new
sign value as per the foregoing schedule.
C. Upon application, prior to 60 days before
the expiration date of the abatement period for a particular sign, the
owner of said sign may request an extension of the abatement period. -
The Planning Commission may grant such an extension if, after hearing
testimony at a public hearing, it determines that the correction or
removal of an existing sign within the period set forth in the fore-
going abatement schedule will create a hardship for the owner or user
and, although different from that permitted by provisions of this
Article, will not be detrimental to its neighborhood environment for
a limited period of time. The total abatement period, including such
extensions asmaybe granted by the Planning Commission, may in no
case exceed five (5) years.
D. An appeal regarding the application of this
article may be made to the City Council by the applicant, any govern-
mental body or agency, by the owner of real property located within
the City, or by any resident of the City. Such appeal shall be filed
within (10) days from the date on which the decision on the applica-
tion being appealed was made. After conducting a public hearing on
an appeal, the City Council may, by resolution, affirm, reverse, or
modify, in whole or in part, an order or decision by the Planning
Commission regarding the application of this Article.

SECTION 2. This ordinance shall take effect and be in force
thirty ays from and after its passage.
SECTION 3. The City Clerk shall certify to the adoption of this
ordinance anise the same to be published once in a newspaper of
general circulatiun in the City of San Juan Capistrano within fifteen
(15) days after its passage.
PASSED, APPROVED AND ADOPTED this 9th day of July, 1973, by the
