ORDINANCE NO. 229
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING PORTIONS OF ORDINANCE NO. 115 RELATING
TO OPEN SPACE REQUIREMENTS.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES ORDAIN AS
FOLLOWS:
SECTION 1. Ordinance No. 115 is hereby amended to define
and set forth open space requirements for development of land in the
City of San Juan Capistrano as follows:
A. The following definition is hereby added to Section 2
of Ordinance No. 115:
OPEN SPACE: Area not covered by residences, structures,
facilities, patios, public and/or private streets, driveways, drive
approaches, and parking areas.
Furthermore, land dedicated to a public agency for parks
or other purposes shall not be counted as open space in meeting "mini-
mum open area requirements" as required in this ordinance. Moreover,
in order to qualify as "open space", land in residential districts
shall:
1) not be a part of a slope bank exceeding a 2-1
ratio;
2) have a minimum width of ten (10) feet;
3) have a contiguous area of not less than 300
square feet;
4) provide for installation and maintenance of
landscaping.
B. Section 4.12.4 shall be amended to read:

DEVELOPMENT STANDARDS:
A. The development will be so buffered and fenced to separate
it from other use areas. Buffer area will be designated on final site
plans.
B. Landscaping for common areas approved as part of final
site plans must have a method for perpetuating maintenance of the area.
C. Trash and garbage areas shall be screened and adequate
access to and from these areas shall be provided.

D. Plans and specifications for private streets will be
approved by the Orange County Department of Building and Safety.
Public streets to be constructed to City standards and dedicated to
the City.
E. Dwellings and accessory buildings and structures shall
provide a non -monotonous orientation so as to provide a separation of
vehicular traffic and play areas and recreational areas for the in-
habitants.
F. Off street parking will be landscaped with a buffer,
either wall, bush, or shrub.
G. All utilities shall be underground.
If. All points of vehicular access to and from off-street
parking areas and driveways onto streets shall be approved by the City
Engineer. Whenever private streets enter onto public streets, a stop
signal shall be erected and maintained at such exit p nt and access
to subject private streets shall be waived to the Cit

SECTION 2. The City Clerk shall certify to the adoption of
this ordinance and cause the same to be published once in a newspaper
of general circulation in the City of San Juan Capistrano within
fifteen (15) days following the passage thereof.
