ORDINANCE NO. 218
AN ORDINANCE OF THECITYCOUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO ESTABLISHING AND ADOPT-
ING BY REFERENCETHELICENSING AND REGULATION
OF MERCHANT PATROL SYSTEMS AND MERCHANT PATROL-
MEN OF THE COUNTY OF ORANGE, BEING A PORTION
OF TITLE 5 OF THE CODIFIED ORDINANCES OF THE
COUNTY OF ORANGE AND REPEALING ORDINANCE NO.92. -
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES ORDAIN
AS FOLLOWS:
SECTION 1. There is hereby adopted by the City Council of the
City of San Juan Capistrano for the purpose of jicensing and regu-
lating Merchant Patrol Systems and Merchant Patrolmen in the City
of San Juan Capistrano, those certain applicable ordinances of the
County of Orange, State of California, contained in titles of the'
CODIFIED ORDINANCES OF THE COUNTY OF ORANGE. Three (3) copies of
said Title 5 are on file with the City Clerk, and are open to public
inspection. The same are adopted hereby and incorporated herein as
though fully set forth in length.
.SECTION 2:. The following amendments to said ordinance are
hereby simultaneously with the adoptionthereofto clarify its
applicability to and'administration by theCityof San Juan
Capistrano.
a. Unless the content clearly indicates otherwise, the terms
"BOARD" and "BOARD OF SUPERVISORS" shall mean the City Councilof
the City of San Juan Capistrano and all other officers mentioned
therein shall refer to their respective counter -parts, if any, in
.the City of San Juan Capistrano. -
b. Section 51.021 of the aforesaid ordinance of the County .
of Orange is amended to read as follows:
"It shall be unlawful for any person, firm or
corporation to engage in, conduct, manage or
carry on the business, practice, profession
or occupation of security officer of security
system within the City limits of the City of
San Juan Capistrano without first having ob-
tained a license therefor in accordance with
Division 2 0£ this Title. Furthermore, any
such person, firm or corporation, conducting
such a security system shall also procure a
City license and pay a license fee of $50.00
per year."

C. In addition to the provisions of the aforesaid Title 5,
each applicant for a license or permit shall: 11
1. File with the City a surety bond executed by a
1 surety company authorized to do business in the State of California,
2 in the sum of One Thousand Dollars ($1,000), conditioned for the
3' faithful and honest conduct of his business by such applicant. Such
4�i bond shall be approved by the City Attorney as to form, execution
5 and sufficiency of the surety.
6 The conditions of such bond must be substantially such
7 that the principal therein will faithfully conform to each and all
8 ordinances of the City, and to each and all laws of the State,
9 whether then in force, or which may thereafter be adopted, relating
10 to the business of the applicant.
11 The principal and surety named in said bond, and their
12i successors and assigns, shall be jointly and severally bound unto
13 the City and unto any and every person aggrieved or damaged by a
14 breach of the conditions of said bond; and said bond shall not be
15 void upon said recovery, but may be sued and recovered upon from
16� time to time by any person aggrieved or damaged, until the whole
_17 penalty is exhausted.
18 In the event that the total liability of the surety upon'
19 such bond falls below One Thousand Dollars ($1,000), applicant shall
- 20 furnish an additional bond to keep the liability at a minimum of
21 One Thousand Dollars.
22 2. If the applicant intends to, or does, operate any motor
23 vehicles in the operation of his business, he shall file with the
.24 City Clerk an insurance policy for each of said vehicles, which shall,
25 include within its coverage, public liability.to the extent of
261 Twenty -Five Thousand Dollars ($25,000), for the death or injury of
27one person, Fifty Thousand Dollars ($50,000) for the death or injury
88 of two or more persons, and property damage in the sum of Five Thou -
29 sand Dollars ($5,000).
30SECTION 3. This ordinance shall take effect and be in force
31 thirty (30) days fromandafter its passage thereof, and prior to

the expiration of fifteen (15) days after the passage thereof, this
ordinance shall be published once in a newspaper of -general -circula-
tion in the City of San Juan Capistrano .
PASSED, APPROVED AND ADOPTED this 26th day of February, 1973,
by the following vote, to wit:-
