2 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SAN JUAN CAPISTRANO AMENDING
3 ORDINANCE NO. 115 AND REPEALING ALL
ORDINANCES IN CONFLICT WITH SAID AMENDMENT

5 THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES '^'I
6 HEREBY ORDAIN AS FOLLOWS:
7 SECTION 1. That Section 4.12.4 of Ordinance No. 115, is
8 rescinded and the following substituted therefor:
9 4.12.4 MINIMUM OPEN AREA REQUIRED: 40%. The term
10 "open area" is defined as area not covered
11 by residences, structures, facilities, patios,
12 public and/or private streets, driveways and
13 drive approaches. -
14 - SECTION 2. That Section 4.12.9 of Ordinance No. 115, is
15 rescinded and the following substituted therefor:
16 4.12.9 DEVELOPMENT STANDARDS:
17 A. The development will be so buffered and fenced to
18 separate"it from other use areas. Buffer area
19 will be designated on final site plans.
20 B. Landscaping for common areas. approved as part
21 of final site plans must have a method for ,
22 " perpetuating maintenance of the area.
23 C. Trash and garbage areas shall be screened and
24 adequate access to and from these areas shall
25 be provided. -

26 D. Plans and specifications for private streets will
27 be approved bytheOrange County Department of Buil-
28 ding and Safety. Public streets to be constructed to
29 City standards and dedicated to the City.
30 E. Dwellings and accessory buildings and structures
31 shall provide a non -monotonous orientation so as to
32 provide a separation of vehicular traffic and play
areas and recreational areas for the inhabitants.
F. Off street parking will be landscaped with a
buffer, either wall, bush, or shrub, to provide
a screen from the residents' view.
G. All utilities shall be underground.
'H. All points of vehicular access to and from off-
street parking areas and driveways onto streets
shall be approved by the City Engineer. Whenever.
private streets enter onto public streets, a stop
signal shall be erected and maintained at such
exit point and access to subject private streets
shall be waived to the City.
SECTION 3. Effective Date.
This ordinance is an urgency ordinance for the immediate
preservation of the public peace, health, welfare and safety adopted
in accordance with Section 65858 of the Government Code, and shall
take effect immediately. The facts constituting the urgency are as -
follows:
The Planning Commission of the City of San Juan Capistrano
is currently studying the revision of the Zoning Ordinance for the
City of San Juan Capistrano, particularly the open space requirements.
for planned developments as set forth in Sections 4.12.4 and 4.12.9
of Ordinance No. 115. In the interim, however, the City requires
an ordinance providing a clarification and definition of "open space"
which will apply to current PD development.
SECTION 4. The City Clerk shall certify to the adoption
of this ordinance and cause the same to be published once in a
newspaper of general circulation in -the -City of San Juan Capistrano
within fifteen (15) days following the passage thereof.

1972, by the following vote, to wit:
