Ordinance Number 1981 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22' 23I 24 25 2611, 27 28 29 30i 31 32 34.5 ORDINANCE NO. 198 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CREATING A PARKS AND RECREATION COMMISSION, AND PRESCRIBING ITS DUTIES AND REPEALING ORDINANCE NO. 166 THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY ORDAIN AS FOLLOWS: d SECTION 1. Membership: There is hereby created a Parks and Recreation Commission consisting of seven (7) members, appointed by the City Council as follows: a) One member from each of the four Parks and Recreation Dis- tricts established as a part of the Parks and Recreational Element of the General Plan of the City of San Juan Capistrano. b) One member to be selected to represent the Capistrano Unified School District. ~ c) Two members to be chosen from the City at large. d} Office: Each member of the Parks and Recreation Commis- sion shall be appointed bythe .City Council for terms coinciding that of the appointing Councilmen; a member may, nevertheless, be removed at any time, by a majority vote of the City Council. SECTION 2. Organization: The Commission upon its organiza- tion shall adopt rules and regulations providing for the staggering of the terms of its members to comply with the requirement of Section 1 (d) herein, the election of officers, the establishment of times and places for the meetings, the adoption of procedures therefor, and such other matters as will lead to the orderly and efficient transaction of the duties hereinafter set forth. SECTION 3. Meetings: The aforesaid rules and regulations shall provide for the appointment of a chairman or presiding officer who shall be charged and vested with the authority to maintain proper order and decorum at all commission meetings. To this end, any persor. who, while in attendance at any Commission meeting, uses a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 profane language, or language tending to bring the Commission, or any of its members, or any official of the City into contempt, or any person who persistently interrupts the proceedings of the Commission, or refuses or fails to be seated or keep quiet when ordered to do so by the presiding officer, shall be guilty of a misdemeanor and punishable by a fine not to exceed One Hundred Dollars ($100) or by imprisonment in the County Jail fora period not to exceed ten (10) days, or by both such fine and imprisonment. In all matters and things not otherwise provided for herein, the proceedings shall be governed by "Robert's Rules of Order''-', Revised Edition. However, no ordinance, resolution, proceeding or other action of the Commission shall be invalidated, or the legal- ity thereof otherwise effected, by the failure or omission to ob- serve or follow said rules. SECTION 4. Duties of the Commission:. The Commission shall have the following duties: 'a) To act in an advisory capacity to the City Council and. City Staff in all matters pertaining to parks and recreation, and to cooperate with other governmental agencies and civic groups in the advancement of sound parks and recreation planning and program- ing. b) To recommend policies on recreation service for the approval of the City Council. - - c) To advise with the City Staff on problems of development ..� of recreatitnal areas, facilities, programs, and improved recrea- tional services. d) To recommend the adoption of standards on areas, facilities, programs and financial support. e) To have periodic inventories made of recreational ser- vices that exist or may be needed, and to interpret the needs of the public to the City,Council, the Board of Trustees of the Capistrano Unified School District, and the City Staff. 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19, 201 21 22 23 24 25 26 27 28 29 30 31 321 34'7 f) To aid in coordinating the recreational services with the programs of other governmental agencies and voluntary organizations. g) To review the effectiveness of the Parks and Recreation Program with the City Staff. h) To interpret the policies and functions of the Parks and Recreation Program to.the public. i) To review the annual budget of the Paris and Recreation Program before presentation to theCityManager and City Council,and, to advise the Cit3r Staff on the development of the long range capital improvement program. SECTION 5. This. ordinance shall take effect and be in force thirty (30) days after its passage and prior to the expiration of fifteen (15) days after the passage thereof, this ordinance, shall be published once in the Coastline Dispatch, a newspaper of general circulation in the City of San Juan Capistrano, County of Orange, State of California. - PASSED, APPROVED AND ADOPTED this 24th day of July, 1972, at a regular meeting of the City Council of the City of San Juan Capis- trano, by the following vote, to wit: AYES: COUNCILMEN: CHERMAK, GAMMELL, THORPE and WEATHERS NOES: COUNCILMEN: NONE ABSENT: COUNCILMEN: BYRNES - ATTEST: Wanda L.
