ORDINANCE NO. 193 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING A DEPARTMENT OF PUBLIC SAFETY The City Council of the City of San Juan Capistrano does ordain as follows: SECTION 1. A Department of Public Safety for the City of San Juan Capistrano is hereby established. SECTION 2. The Department of Public Safety shall consist of a Director of Public Safety and subordinate officers and personnel as are necessary to enforce the laws and keep the peace within the City of San Juan Capistrano, i SECTION 3. All subordinate officers shall report to the Director each day as to events occurring while such officers are on duty, and all other information pertaining to general regulations in the City which come to their notice. SECTION 4. The Director of Public Safety is responsible to and operates with the general supervision of the City Manager. The Director will administer the Department through such staff assistance as provided by the City Council and City Manager and within general guidelines established from time -to time by the City Manager. The Director of Public Safety will organize his department into the minimum number of sections necessary to identify and provide specialized functions in a responsive and efficient manner. In all its operations the Department of Public Safety will coordinate its programs, records and functions with the needs and objectives of other City Departments and other public agencies in such a way as to promote the best public interest. SECTION 5. All officers shall, at all times, be subject to the orders of the Director of Public Safety and shall be subject to call by the Director of Public Safety at any time during the day or night. SECTION 6. All advancements to the next higher classification and salary increase shall be made according to the ordinances of the City of San Juan Capistrano. SECTION 7: The Director of Public Safety shall be appointed by the City Manager with approval by the City Council. SECTIONS. It shall be the duty of each and every member of the Public Safety Department to enforce impartially all of the laws and statutes of the United States and of the State of California, all ordi- nances of the County of Orange and the City of San Juan Capistrano within the limits=of this City and to perform such other duties as by statute and ordinance now existing or hereafter enacted that may be imposed upon them in their capacity as officers. SECTION 9. Each and every member of the Public Safety Department is hereby authorized to make arrests and detain prisoners in all cases where a peace officer is so authorized under the laws of the State of California. SECTION 10. It shall be unlawful for any person to willfully make to the Public Safety Department, or any officer in said department, any false, misleading or unfounded report for the purpose of interfering with the operation of said department or officer, or for the purpose of inducing or causing to be issued a complaint or indictment against any person, firm or corporation. If such report be so filed, it shall be a misdemeanor punishable as set forth by the laws of the State of California. SECTION 11. The Director of Public Safety and deputy officers shall have the same powers that are now or may hereafter be conferred by the laws of this state, and shall be entitled to the same protection as set forth by state laws. SECTION 12. It shall be the duty of the Director of Public Safety _ and all deputy officers to help or assist in the prosecution and investi- gation of all noncompliance with any ordinance or laws which shall come to the attention of the Public Safety Department. SECTION 13. Severability. If any section, subsection, subdivision, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Council hereby declares that it would have passed this ordinance and each section, subsection, sub- division, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, or phrases be declared unconstitutional. SECTION 14. The City Clerk of the City of San Juan Capistrano shall certify to the adoption of this ordinance and shall, before the expiration of fifteen (15) days after the passage thereof, cause the same to be published once, with the names of the members of the City Council voting for and against the same in the Coastline Dispatch, a newspaper of general circulation.
