ORDINANCE NO. 181
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO APPROVING THE ANNEXATION TO
THE CITY OF SAN JUAN CAPISTRANO OF THE TERRITORY
KNOWN AS "ROSENBAUM ANNEXATION NO. 2 TO THE CITY
OF SAN JUAN CAPISTRANO"
The City Council of the City of San Juan Capistrano does
ordain as follows:
SECTION 1. That the proposal for the annexation of the
territory hereinafter described to the City of San Juan Capistrano
was submitted to the Local Agency Formation Commission of the County
of Orange, State of California.
That said territory proposed to be annexed to said City of
San Juan Capistrano is contiguous to the City of Saj Juan Capistrano
and is uninhabited territory.
That the Local Agency Formation Commission did, at a regu-
lar meeting held on March 24, 1971, approve the aforesaid application
with modifications.
That on May 7, 1971, the proponents of the annexation peti-
tioned the City Council of the City of San Juan Capistrano for annex-
ation of said territory to the City of San Juan Capistrano.
That the City Council duly assembled..at a regular meeting of
said City Council on the 24th day of May, 1971 did find that said
petition at the time it was filed and received was signed by the owners
of not less -than -one-fourth of the land in the territory by area and
by assessed value, as shownonthe last preceding equalized assessment
roll of the County of Orange, State of California,- in which said terri-
tory is situated, and did on said date adopt Resolution No. 71-5-24-2
specifically describing the boundaries of the territory so proposed
to be annexed to the City of San Juan Capistrano and designating such
territory as "Rosenbaum Annexation No. 2" and giving notice of such
annexation and fixing the 12th day of July, 1971, at the hour of 7:00
o'clock PM, at the City Council chamber in the City Hall of the City
of San Juan Capistrano, as the day, hour and place for hearing of
oral and written protests to said annexation and when and where any
person owning real property within such territory'so proposed to be
annexed and having objections to the proposed annexation might appear
before the City Council of theCityof San Juan Capistrano and present
oral or written objections to the annexation of said territory to the
-- City of San Juan Capistrano, and directing the City Clerk to publish
or cause to be published a copy of said resolution at least twice,
but not oftener than once a week, for two successive weeks prior to
the date of said hearing, in a newspaper of general circulation in
the City of San Juan Capistrano, to wit: The Coastline Dispatch of
San Juan Capistrano, California, and directing that said publication
be completed at least twenty (20) days prior to the date of hearing
hereinabove mentioned; and further directingthe City Clerk of the
City of San Juan,Capistrano to cause written notice^of such proposed
annexation -to be mailed to each person to whom land within -the terri-
tory -proposed to be annexed -is -assessed in the last equalized assess-
ment roll available on the date the proceedings were initiated, at
the address shown on said assessment roll or as known to said City
Clerk, and to any person who has filed his name and address and the
designations of lands in which he has any interest, either legal or
equitable, with said City Clerk; and that in the event that land with-
in the territory proposed to be annexed to the City of San Juan Capis-
trano is owned by a County that the City Clerk shall cause written
notice of such proposed annexation to be mailed to the Board of
Supervisors of such County, and directing such notices be given not
less than twenty (20) days before the first public hearing on the
proposed annexation.
That on the 12th day of July, 1971, at the hour of 7:00
o'clock PM, in the City Council chamber in the City Hall in the City
of San Juan Capistrano, California, the City Council of the City of
San Juan Capistrano did meet and assemble to hear and pass on all
protests filed or received up to the closing of the hearing on said
protests and the City Council did find that the resolution fixing
the time and place of said hearing was published by the City Clerk,
as herein directed, and that written notice of such proposed annex-
ation was mailed to each person to whom land within the territory
proposed to be annexed is assessed, or in which such person has any
interest, by the City Clerk as directed in said resolution. That said
hearing on protests was closed on the 12th day.of July, 1971. That
written protests were not made by the owner or owners of one-half of
the value of the territory proposed to be annexed. according to the
last equalized assessment roll of the County of Orange, State of
California, nor were protests made by public or private owners equal
to one-half of the value of the territory proposed to be annexed as
determined by the City Council and Resolution No. 71-7-12-1 was passed
on the 12th day of July, 1971, declaring that there was not a majority
protest.
SECTION 2. That the territory included within the boundaries
of the aforesaid "ROSENBAUM ANNEXATION NO, 2" TO THE CITY OF SAN JUAN
CAPISTRANO (REVISED March 24, 1971) is described as follows:
All that real property in the County of Orange, State of
California, being that portion of Section 25, Township 7 South, ,-
Range 8 WJst of the San Bernardino Meridian according to the
Official Plat thereof filed in the District Land Office together
with that portion of the Rancho Mission Viejo per map thereof
filed in Book 8, Pages 34 to 46 inclusive of Record of Surveys
in the office of the County Recorder of said County, together
with that portion of Tract Number 112 per map thereof recorded
in Book 11, Page 12 of Miscellaneous Maps in the office of said
County Recorder, described as a whole as follows:
Beginning at the intersection of the Southwesterly line of
said Rancho Mission Viejo with the East-West Quarter Section line
of said Section 25, said intersection being an angle point in the
existing boundary of the City of San Juan Capistrano as established
by Ordinance Number 103 and certified by the Secretary of State on
January 28, 1965; thence along said existing boundary the following
courses: South 800 49' 14" West 1932.51 feet, South 120 58' 54"
West 394.20 feet, South 610 30' 36" East 271.21 feet, North
830 09' 24" East 137.46 feet, South 20 48' 54" West 450.85 feet,
South 410 23''09" West 453.79 feet, North 860 21-' 06" West 264.40
feet, North 190 04' 06" West 145.51 feet, Southwesterly 83.13 feet
along a non -tangent curve concave Southeasterly and having a radius
of 300.00 feet from a radial bearing North 450 09' 55" West through
a central angle of 150 52' 39", South 280 57' 26" West 138.36 feet,
Southwesterly 240.05 feet along a tangent curve concave Northwest-
erly and having a radius of 250.00 feet through a central angle
of 550 01' 00", South 830 58' 26" West 217.96 feet, Southwesterly
and Southeasterly 255.47 feet along a tangent curve concave South-
easterly and having a radius of 125.00 feet through a central
angle of 1170 06' 00", South 330 07' 34" East 176.78 feet, South-
erly 194.43 feet along a tangent curve concave Westerly and having
a radius of 449.20 feet through a central angle of 240 48' 00",
Southwesterly 204•.19 feet along a compound curve concave North-
westerly and having a radius of 186.32 feet through a central
angle of 620 47' 30", Southwesterly 158.14 feet along a reverse
curve concave Southeasterly and having a radius of 350.00 feet
through a central angle of 250 53' 17" and South 400 20' 56" West
105.68 feet to a point on the boundary of the City of San Juan
Capistrano as it existed on April 19, 1961, said point being on a
curve in said boundary- concave Southwesterly and having a radius
of 2879.00 feet, a radial to said point bears North 409 20' 56"
East; thence, along said boundary as it existed on April 19, 1961
the following courses: Northwesterly 76.99 feetalongsaid curve
through a -central angle of l0 311 56", North 510 11' 0011 West
810.44 feet and Northwesterly 1270.71 feet along 'a tangent curve
concave Northeasterly having a radius of 2109.00 feet through a
central -angle of 340 31' 18" to the intersection of said boundary
with that' -certain course shown as South 899 23' 30" East 416.13
feet on the map filed in Book 8, Page -2 of RecordofSurveys,
records of said Orange County;•thence leaving said existing boun-
dary and proceeding along the boundary of the land shown on said
map the following courses: South 890 23' 30" East 291.40 feet,
North 280 36' 00" East 108.06 -feet, North -450 37' 3011 East 54.22
feet, South 859 00''00" East 100.25 feet and North 620 57' 00"
East'327.35 feet to the Southwesterly corner of -,the land shown on
the map filed in Book 17, Page -2 of Record'of Surveys, records of
said County; thence along the boundary of said land the following
courses: North 160 35' 00" East -113.90•feet; North 340 32' 30"
East 269.33 feet, North 100 33' 30" West 206.81 -feet and South
689 08' 00" East 115.59 feet to themostEasterly- corner of the
land shown on themapfiled in Book 14; Page 46 of Parcel Maps,
recordsofOrange County; thence; along the boundary of said land
the following courses: North 70 40'-00" West 129:72 feet, North
50° 04' -00" -West 137.33 -feet -and North 230-01' 30" East 85.64
feet to-themost Southerly corner of Tract -Number 5962 per map
thereof recorded in Book 221, Pages 7 and 8of Miscellaneous '

of said Tract the following courses: North 230 O1' 30" East
271.94 feet, North 110 51' 00" East 54.23 feet, North 280 54' 30"

280 53' 00" East 113.43 feet to a point South 280 53' 00" West
20.03 feet from the Northerly terminus of that certain course
shown as South 280 53' 00" West 133.46 feet on the map filed in
Book 16, Page 49 of Record of Surveys records of said Orange
County; thence, along the boundary of said landthe following
courses: North 280 53' 00" East 20.03 feet, North 310 43' 30"
East 73.30 feet, North 370 49' 30" East 140.83 feet, North 480 _
24' 30" East 148.85 feet and North 550 28' 25" East 20.37 feet
to the most Southerly corner of the land described as Parcel 2
in the deed recorded in Book 8279, Page 357 of Official Records,
records of Orange County; thence, along the Northwesterly boun-
dary of said land the following courses: North 50 20' 00" West
134.30 feet, North 480 10' 54" East 130.42 feet, North 350 58'
40" East 153.70 feet, North 130 32' 30" West 127.10 feet and
North 90 00' 40" East 95.25 feet to the most Westerly corner of
the land described as Parcel 1 in said deed; thence North 250
30' 00" East 187.89 feet along the. Northwesterly line of said
Parcel 1 to the Southwesterly line of said Rancho Mission Viejo;
thence South 530 44' 07" East 227.22 feet along said Southwesterly
line to the boundary of the land shown on the map filed in Book
16, Page 49 of Record of Surveys, records of said Orange County;
thence, along said boundary the following courses: North 330
37' 30" East 8.64 feet, South 540 13' 00" East 1313.12 feet and
South 300 42' 00" West 19.80 feet to the Southwesterly line of
said Rancho Mission Viejo; thence South 530 44' 07" East 1693.20
feet along said Southwesterly line to the point of beginning.
Containing an area of 162 acres, more or less.
is hereby approved and said territory is hereby annexed to and incor-
porated in the City of San Juan Capistrano, County of Orange, State of
California, and is hereby designated as "ROSENBAUM ANNEXATION NO. 2
TO THE CITY OF SAN JUAN CAPISTRANO".
SECTION 3. That from and after the effective date of this
Ordinance and the filing of a certified copy thereof with the Secretary
of State of the State of California, of the annexation of the territory,
thenceforth such annexed territory shall be, to all intents and pur-
poses, a part of the City of San Juan Capistrano, and from and after
the effective date of such annexation, all property therein shall be
subject to taxation equally with the property within the City of San
Juan Capistrano.
SECTION 4. The City Clerk shall certify to the passage of
this Ordinance and cause the same to be published once in the Coastline
Dispatch, a newspaper of general circulation in the City of San Juan
Capistrano, County of Orange, State of California, and thirty days
from and after its final passage it shall be in full force and effect.
THE FOREGOING ORDINANCE is approved and signed by me this
26th day of July, 1971.
