ORDINANCE NO. 179
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
ESTABLISHING AND ADOPTING BY REFERENCE THE ORANGE
COUNTY UNIFORM HOUSING CODE AS THE UNIFORM HOUSING
CODE OF THE CITY OF SAN JUAN CAPISTRANO AND REPEAL-
ING ORDINANCE NO. 141
The City Council of the City of San Juan Capistrano does here-
by ordain as follows:
SECTION 1. There is hereby adopted by the City Council of
the City of San Juan Capistrano for the purpose of prescribing regula-
tions for the erection, construction, enlargement, alteration, repair,
maintenance, moving, improving, removal, conversion, demolition, and
occupancy of all buildings or portions thereof used, or designed or
intended to be used for human habitation, in the City of San Juan
Capistrano, that certain Ordinance of the County of Orange, State of
California, known as "ORDINANCE NO. 2490. AN ORDINANCE REPEALING
SECTIONS 71.0241, 71.0242, 71.0243, 71.0244, 71.0245, 71.0246, 71.0247,
71.0248, 71.0249, 71.0250 and 71.0251 AND ADDING SECTIONS 71.0241,
71.0242, 71.0243 AND 71.0244 TO THE CODIFIED ORDINANCES OF THE COUNTY
OF ORANGE, CALIFORNIA". Three (3) copies of said Ordinance and three
(3) copies of the Uniform Housing Code, 1970 Edition, (Uniform Build-
ing Code, Volume III) including the Appendix thereto, except Chapters
11, 12, 13, 14, 15 and 16, and the whole thereof save and except such
portions as are deleted, modified, or amended in said Ordinance No.
2490, are on file with the City Clerk and are open to public inspection.
The same is hereby adopted and incorporated herein as though fully
set forth in length.
SECTION 2. In the event of any dispute or disagreement as
to the administration of this Ordinance, the determination of the City
Council of the City of San Juan Capistrano shall be final. The. City
of San Juan Capistrano reserves the right to waive, upon review and
determination of the City Council, any provision of this Ordinance.
SECTION 3. Ordinance No. 141 is hereby repealed except that
any matters commenced hereunder shall be processed to completion under
its terms.
SECTION 4. This ordinance is declared to be an urgency
measure necessafy for the immediate preservation of the public peace,
health and safety and shall become effective immediately. The facts
constituting the urgency are: this Ordinance is administered and
enforced by the Department of Building and Safety of the County of
Orange, and cannot be enforced until it is in full force and effect.
SECTION 5. Before the expiration of fifteen days after the
passage thereof, this ordinance shall be published once in the Coast-
line Dispatch, a newspaper of general circulation, together with the
names of the City Council voting for and against the same.
