ORDINANCE NO. 177
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
ESTABLISHING AND ADOPTING BY REFERENCE THE ORANGE
COUNTY UNIFORM MECHANICAL CODE AS THE UNIFORM
MECHANICAL CODE OF THE CITY OF SAN JUAN CAPISTRANO
AND REPEALING ORDINANCE NO. 142
The City Council of the City of San Juan Capistrano does
hereby ordain as follows:
SECTION 1. There is hereby adopted by the City of San Juan
Capistrano for the purpose of prescribing regulations for the protection
of the public health and safety and establishing minimum regulations
for the installation, alteration, design, construction, quality of
materials, location, operation, and maintenance of heating, ventilating,
comfort cooling, refrigeration systems, incinerators and other miscel-
laneous heat -producing appliances and the inspection thereof in the
City of San Juan Capistrano, that certain Ordinance of the County of
Orange, State of California, known as "ORDINANCE NO. 2491. AN ORDI-
NANCE REPEALING DIVISION 4 OF TITLE 7 OF THE CODIFIED ORDINANCES OF
THE COUNTY OF ORANGE, CALIFORNIA, AND ADDING DIVISION 4 OF TITLE 7 TO
THE CODIFIED ORDINANCES OF THE COUNTY OF ORANGE, ADOPTING BY REFERENCE
THE 1970 EDITION OF THE UNIFORM BUILDING CODE VOLUME II, KNOWN AS THE
'UNIFORM MECHANICAL CODE', INCLUDING THE APPENDIX THERETO, AND ADOPT-
ING MODIFICATIONS AND AMENDMENTS TO THIS SAID 1970 EDITION OF THE
'UNIFORM MECHANICAL CODE"'. The 1970 edition of the "Uniform Mechani-
cal Code" including the Appendix thereto which are on file with the
City Clerk and are open to public inspection. The same is hereby
adopted and incorporated herein as though fully set forth in length.
SECTION 2. In the event of any dispute or disagreement as
to the administration of this Ordinance, the determination of the City
Council of the City -of San Juan Capistrano shall be final. The City
of San Juan Capistrano reserves the right to waive, upon review and
determination of the City Council, any provision of this Ordinance.
SECTION 3. Ordinance No. 142 is hereby repealed, except
that any matters commenced thereunder shall be processed to completion
under its terms.
SECTION 4. This Ordinance is declared to be an urgency meas-
ure necessary for the immediate preservation of the public peace,
health and safety and shall become effective immediately. The facts
constituting the urgency are: this Ordinance is administered and en-
forced by the Department of Building and Safety of the County of
Orange, and cannot be enforced until it is in full force and effect.
SECTION 5. Before the expiration of fifteen days after the
passage thereof, this ordinance shall be published once in the Coast-
line Dispatch, a newspaper of general curculation, together with the
names of the City Council voting for and against the same.
PASSED, APPROVED and ADOPTED this 2nd day of July, 1971.
