ORDINANCE NO. 156
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SAN JUAN CAPISTRANO AMENDING
SECTION 5 OF ORDINANCE NO. 132 AND DE-
CLARING THE URGENCY THEREOF.
The City Council of the City of San Juan Capistrano does hereby ordain
as follows:
SECTION ONE: That Section 5 of Ordinance No. 132 be and the same is
hereby amended to read as follows:
"SECTION 5. TRANSFER TAX - GOVERNMENTAL EXCEPTION"
"Any deed, instrument or writing to which the United States or any
agency or instrumentality thereof, any state or territory, or political sub-
division thereof, is a party, shall be exempt from the tax imposed pursuant to
this,Article when the exempt agency is acquiring title."
SECTION TWO: EFFECTIVE DATE. This ordinance is an urgency measure
and shall take effect immediately upon adoption. The facts establishing such
urgency are as follows: During the 1969 Regular Session of the Legislature,
certain amendments to the Documentary Transfer Tax were made which make the
foregoing amendment necessary. That this ordinance must become effective
prior to the effective date of the 1969 Legislative action, to wit., on
November 10, 1969, in order to maintain continuity in the collection and
distribution of such tax.
SECTION THREE: The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published once within fifteen (15)
days after its adoption in the Coastline Dispatch, a newspaper of general
circulation, printed, published and circulated in said City.
PASSED, APPROVED and ADOPTED this 28th day of October, 1969.
