Ordinance Number 121WIN ORDINANCE NO. 121 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, PROHIBITING THE ERECTION OF CERTAIN STRUCTURES WITHIN THE PUBLIC RIGHTS OF WAY WITHIN THE CITY OF SAN JUAN CAPISTRANO; AND DECLARING THE URGENCY THEREOF SECTION 1: Purpose. This ordinance is enacted to implement the Land Use Ordinance of the City of San Juan Capistrano. The land Use Ordinance sought to establish and preserve the orderly development of the City of San Juan Capistrano, while at the same time perpetuating the historical atmosphere surrounding the center of the City and the Mission of San Juan Capistrano. Other ordinances of the City seek underground utilities and proper setbacks and sppcing of residential areas. The whole atmosphere of the planned development of San Juan Capistrano is in complete accord with the beautification program sponsored by Lady Bird Johnson and it is the intention of this ordinance to assist the City in continuing towards such goal. , SECTION 2: It shall beunlawfulto erect, cause to be erected, maintained, or cause to be maintained any structure within the public rights of way within the City of San Juan Capistrano, save and except those structures serving the interests of the generalpublic such as fire hydrants, street signs, street lighting, public postal receptacles, and public utility structures. Structures, as used herein, shall mean anything constructed or erected, the use of which requires location on or in the ground, expressly prohibiting rural or other type mailboxes and rural containers for newspapers. SECTION 3: This ordinance is hereby declared to be an urgency ordinance and will take effect immediately upon its passage. The basis for declaring this ordinance an urgency measure is as follows: It is in the interest of the health, safety and general welfare of the citizens of San Juan Capistrano that the borders of their streets and roads within the residential areas of the City be kept free and clear of all types of obstructions. The presence of obstructions between the road edge and the setback line constitutes a distinct hazard to both pedestrian and motor vehicular traffic. It is essential that this ordinance take effect immediately so as not to interrupt the oiUBrlt development of the City. SECTION 4: This ordinance shall take effect immediately upon its passage and within fifteen (1$) days from and after its passage it shall be published once in the Coastline Dispatch, a newspaper of general circulation published within the City of San Juan Capistrano, together with the names of the Councilmen voting for and against the same. 88 PASSED, APPROVED and ADOPTED this 27th day of June, 1966.
