ORDINANCE NO. 320
REGULATING FORTUNE TELLING AND SIMILAR PURSUITS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, REGULATING THE PRACTICE OR EXHIBITION
OF THE BUSINESS OR ART OF ASTROLOGY, PALMISTRY,
PHRENOLOGY, LIFE READING, FORTUNE TELLING, AND
SIMILAR PURSUITS; PROVIDING FOR PENALTIES HERE-
UNDER AND REPEALING ORDINANCE NO. 23
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Fortune telling, mediumship, magic -
Practice for compensation prohibited.
It is unlawful in the City of San Juan Capistrano for
any person, firm or corporation to carry on, practice or profess
to practice the business or art of astrology, palmistry, phrenology,
life reading, fortune telling, cartomancy, clairvoyance, clair-
audience, crystal gazing, hypnotism, mediumship, spirit photography,
spirit writing, spirit voices, spirit materialization, etherealiza-
tion, prophecy, augury, divination, magic, necromancy, character
reading, or fortune telling by handwriting analysis, or other
similar business or art and to demand or receive directly or
indirectly a fee, gift, donation or reward for the exercise or
exhibition of such art therein.
SECTION 2. Fortune telling, spiritualism, magic -
Exhibition for consideration prohibited.
No person shall give an exhibition of astrology, palmistry,
phrenology, life reading, fortune telling, cartomancy, clairvoyance,
clairaudience, crystal gazing, hypnotism, mediumship, spirit writing,
spirit voices, spirit materialization, prophecy, augury, divination,
magic, necromancy, or other similar business or art, at any place
where an admission, fee, gift, donation or reward is charged, asked
or received, directly or indirectly.
SECTION 3. Fortune telling, spiritualism, magic -
Teaching for consideration prohibited.
No person shall teach or give instruction in palmistry,
phrenology, life reading, fortune telling, cartomancy, clairvoyance,
clairaudience, crystal gazing, hypnotism, mediumship, spirit
photography, spirit writing, spirit voices, materialization,
etherealization, prophecy, augury, divination, magic, necromancy,
or other similar business or art and demand, ask or receive,
directly or indirectly, a gift, fee, donation or reward for such
teaching or instance.
Teaching of astrology shall be regulated in the
following manner:
1. Each class meeting shall have a minimum of
five (5) individuals enrolled and in attendance at each
meeting during the session.
2. Private lessons whereby only one (1) student
would be receiving instruction at one time shall be
strictly prohibited.
Counseling or prediction using astrological calcula-
tions and/or methodologies shall be prohibited, nor
shall any fee, gift, donation or reward be collected
for such purposes.
Nothing contained herein shall prohibit the selling
of astrology books and related educational material.

SECTION 4. Any person violating any of the provisions
of this Ordinance shall be guilty of a misdemeanor and shall be
punished by a fine not to exceed Five Hundred Dollars ($500.00),
or by imprisonment in the County jail for a period not to exceed
six (6) months, or by both such fine and imprisonment.
SECTION 5. This Ordinance shall take effect and be in
force 30 days after its passage.
SECTION 6. The City Clerk shall certify to the adoption
of this Ordinance and cause the same to be posted in the duly
designated posting places within the City of San Juan Capistrano
within 15 days after its passage.
PASSED, APPROVED AND ADOPTED, this 18th day of
May , 1977, by the following vote, to wit:
AYES: Councilmen Sweeney, McDowell, Friess, Nash,
and Mayor Heckscher
