ORDINANCE NO. 304
REGULATING AIRPORT USE
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DEFINING AND REGULATING THE USE AND
HOURS OF OPERATION OF THE CAPISTRANO AIRPORT
RUNWAY AND TAXIWAY
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Landing Report Required.
A. All pilots of transient aircraft shall register
with the City Manager upon landing at the Capistrano
Airport, and shall fill out a report in a form
prescribed by him. Transient aircraft shall mean
all aircraft not based in San Juan Capistrano.
SECTION 2. Landing Permit.
A. All owners of locally -based aircraft shall obtain
a landing permit to be affixed on each such aircraft
in a manner prescribed by the City Manager.
B. All pilots of transient aircraft shall upon landing
pay a nominal landing permit fee as set by resolu-
tion of the City Council. The landing permit shall
be affixed to each such aircraft in a manner
prescribed by the City Manager. Each permit shall
be valid for a period of 24 hours or until such
time as the aircraft shall leave the Capistrano
Airport, whichever is later.
C. Law enforcement aircraft are exempt from the pro-
visions of this Section during an emergency, or
with the prior approval of the City Manager.
SECTION 3. Records Required. The airport operator
shall monthly provide the City Manager with a current list of all
aircraft, and the names of their owners, that are either using or
renting space adjacent to the runway or taxiway. In addition,
the monthly report shall include a listing of all transient air-
craft, and the names and addresses of their pilots.
SECTION 4. Prohibited Landings and Takeoffs.
A. No aircraft shall use the runway for "touch and go"
landings.
B. No transient aircraft shall use the runway or taxi-
way for flight instruction purposes.
C. No aircraft shall use the runway or taxiway for any
purpose, if the aircraft has an unladen weight in
excess of 12,500 pounds or is powered by a jet
engine.
D. Law enforcement aircraft are exempt from the pro-
visions of this Section during an emergency, or
with the prior approval of the City Manager.
SECTION 5. Hours of Operation. No aircraft shall
land on or take off from the runway before dawn or 7:00 A.M.,
whichever is later, or after dark or 8:00 P.M., whichever is
earlier, except during a bonafide emergency or with the prior
approval of the City Manager.

SECTION 6. Departure Pattern,
After a takeoff to the southwest on Runway 23, all
aircraft shall proceed straight ahead to the flood
control channel, and then execute a left turn,
following the center of the flood control channel
towards the ocean at the best rate of climb until
outside the City limits or above one thousand feet
elevation.
After a takeoff to the northeast on Runway 5, all
aircraft shall execute a climbing left turn at the
best rate of climb, and either follow the center of
Interstate 5 in a northerly direction or follow the
center line of San Juan Creek in an easterly direc-
tion, until outside the City limits or above one
thousand feet elevation.
SECTION 7. Landing Pattern Elevation. The landing
pattern elevation is one thousand feet.
SECTION 8. Revocation of Landing Permit.
Upon a determination by the City Manager that an
aircraft has been operated in violation of any of
the provisions of this Ordinance, the owner and/or
pilot of the aircraft shall be issued a warning
citation stating that any future violation will
result in a permanent revocation of permission to
land at the Capistrano Airport.
B. Upon a determination by the City Manager that an
additional violation of any of the provisions of
this Ordinance has occurred after a warning
citation, the owner and/or pilot of the aircraft
shall be notified that any annual or daily landing
permit for that aircraft has been revoked, and
that future permission to land at the Capistrano
Airport shall be denied.
C. Any landing permit shall be surrendered to the
City Manager upon a determination of a second
violation as provided in Section 8-B hereinabove.
D. A warning citation or the revocation of a landing
permit shall be in addition to any penalties as
provided in Section 9 hereinafter.
SECTION 9. Penalty. Any person violating any of the
provisions of this Ordinance shall, upon conviction thereof, be
punished by a fine not to exceed Five Hundred Dollars ($500.00),
or by imprisonment not to exceed six (6) months, or by both such
fine and imprisonment.
SECTION 10. Severance Clause. The provisions of this
Ordinance are declared to be severable and if any Section,
sentence, clause or phrase of this Ordinance shall for any reason
be held to be invalid or unconstitutional, such decisions shall
not affect the validity of the remaining sections, sentences,
clauses and phrases of this Ordinance but they shall remain in
effect, it being the legislative intent that this Ordinance shall
stand notwithstanding the invalidity of any part.

SECTION 11. Repeal ofConflictingOrdinances. All
ordinances or parts of ordinances inconsistent with the provisions
of this Ordinance, be and the same are hereby repealed.
SECTION 12. Effective Date. This Ordinance shall take
effect 30 days after its passage, as provided by law.
