RELATING TO STRUCTURES IN THE "LOS RIOS" AREA
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, REQUIRING LAND USE AND OTHER SPECIAL
PERMITS FOR THE CONSTRUCTION, DEMOLITION, REFINISHING,
RENOVATION OR RELOCATION OF ANY STRUCTURES LOCATED
WITHIN AN AREA BOUNDED BY THE SANTA FE RIGHT-OF-WAY,
MISSION STREET, TRABUCO CREEK AND DEL OBISPO STREET
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of San Juan
Capistrano finds and determines that an area of the City bounded by
the Santa Fe Railroad right-of-way, Mission Street, Trabuco Creek,
and Del Obispo Street, hereinafter referred to as the "Los Rios Area,"
contains structures which are of incalculable historic significance
and importance. This City Council further declares that these
structures and the entire Los Rios Area shall be protected and
preserved for posterity,
SECTION 2. Notwithstanding the provisions of any
applicable building, land use or other related ordinances or codes
any person desiring to construct, demolish, refurbish, renovate,
refinish, or relocate any structure located within the boundaries of
the "Los Rios Area" or to establish a land use. whether such use
may be permitted under the City's zoning ordinance, shall, prior to
undertaking any such use action, activity or work, apply to the City
Council for permission therefor.
SECTION 3. This ordinance is an interim urgency ordinance
for the immediate preservation of the public peace, health, safety,
and welfare, is adopted pursuant to Section 65858 of the Government
Code, and shall accordingly take effect immediately. The facts
constituting the urgency are as follows:
The cultural and historical heritage of the
City of San Juan Capistrano are treasures of
inestimable value which must be preserved for
future generations. Unless particular attention
is focused upon the Los Rios Area, original
buildings will be subjected to degradation, and
land uses foreign to the character of said area will
intrude upon an historically important segment of
the City. The City Council of the City of San Juan
Capistrano therefore believes that any and all
activity within the Los Rios Area must be subjected to close
scrutiny of the City Council pending a study and evaluation

by the Planning Department and the Planning Commission
of the City of San Juan Capistrano for the long-term plans for
said area.
PASSED, APPROVED AND ADOPTED this 2nd day of October,
1974, by the following vote, to wit:

and Mayor Byrnes
