AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO AMENDING SECTION 5.13 OF ORDINANCE NO. 115 AND
REPEALING ORDINANCE NO. 228
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. That Section 5.13 is hereby added to Ordinance
No. 115, as follows:
5.13 ESTABLISHING DISTRICT SYMBOLS FOR DENSITY, WIDTH,
BUILDING SITE AND HEIGHT LIMITATIONS.
(a) In order to provide for a reasonable determination and
control of land use intensity within the City of San Juan
Capistrano and to accomplish the objectives of the General Plan,
in any zoning district the maximum density to be permitted
therein may be specified by adding a numerical suffix to the zone
designation.
The numerical suffix shall indicate the gross density per
acre permissible within the zone, and shall be calculated by
dividing or multiplying, as the case may be, the total number
of units permitted into or by the acreage involved, including
open space and roadways.
Unit shall be defined as a building or portion thereof,
designed for occupancy by one (1) family for residential purposes
and having cooking facilities.
The numerical suffix shall be determined by the requirements
of the General Plan, any precise plans affecting the area, and by
the physical features of the area to be included within the
zoning district.
(b) In any zoning district the minimum required building
site width or area or the maximum permitted building height may
be different from that set forth in the regulations of the district
if so specified on the zoning district map. Such specifications
shall be shown in the following manner or in such other manner as
will lead to the same result:
(1) A number preceding and connected by a hyphen with
the district symbol shall designate the minimum required
building site width in feet.
EXAMPLE: 150-R1
(2) A number following the district symbol and
enclosed by parentheses shall designate the minimum required
building site area. When the number is greater than 100,
it shall indicate the area in square feet; where the number is
less than 100, it shall indicate the area in net acres.
EXAMPLE: R1(10,000) or R1(2)
(3) A number shown below and separated by a line from
the district symbol or symbols shall designate the maximum
height of any building or structure in feet.
EXAMPLE: R1
(c) The symbols shown in subsections (a) and (b) above may
be used in any combination to show the maximum density permitted,
minimum site width, minimum building site area or maximum height.

SECTION 2. DECLARATION OF URGENCY. This ordinance is
adopted as an urgency measure pursuant to Section 65853 of the Government
Code, and shall remain in effect for a period of four (4) months from
the date herein. The reason for the urgency is that there are ambi-
guities in the current ordinance relating to the designation of a
numerical suffix to zoning classifications which require immediate
clarification. Amendments contained herein are presently under study
and consideration by the planning staff for inclusion in the revised
zoning ordinance.
SECTION 3. The City Clerk shall certify to the adoption of
this ordinance and cause the same to be published once in a newspaper
of general circulation in the City of San Juan Capistrano within
fifteen (15) days following the passage thereof.

by the following vote, to wit:
