Q'- AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING PORTIONS OF' ORDIN :NCE NO, 198 RELATING
TO THE APPOINT -,,ENT OF MEMBERS TO THE PARKS AND
RECREATION COMMISSION.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Sections 1 and 2 of Ordinance No. 198 be and
are hereby repealed.
SECTION 2. Membership of the Parks and Recreation Com-
mission. The membership of the Parks and Recreation Com-
mission shall consist of five (5) members, not officers
of the City, appointed by the City Council. The City Council
hereby designates the following officers of the City as ad-
visory members of the City Parks and Recreation Commission;
the Director of Planning and Director of Public Works.
Advisory members shall not have the right to vote on any
matter before the Commission. Advisory members may desig-
nate a deputy to sit with the Commission in their absence.
SECTION 3. Office. Each member of the Parks and Recreation
Commission shall be a resident of the City of San Juan
Capistrano and shall be nominated by a City Councilman
and appointed with the concurrence of the majority of the
Council. The term of office shall coincide with that of
the City Council.
SECTION 4. Section 4 of Ordinance No. 198 is amended to
read as follows:
"Meetings: The Commission shall adopt rules and regu-
lations which shall establish the time and place of a
regular meeting which shall take place at least once
a month and shall provide for the appointment of a
chairman or presiding officer who shall be charged and
vested with the authority to maintain proper order and
decorum at all Commission meetings. To this end, any
person, who, while in attendance at any Commission
meeting, uses profane language, or language tending to
bring the Commission, or any of its members, or any
official of the City into contempt, or any person who
persistently interrupts the proceedings of the Com-
mission, or refuses or fails to be seated or keep quiet
when ordered to do so by the presiding officer, shall
be guilty of a misdeamenor and punishable by a fine not
to exceed One Hundred Dollars ($100) or by imprison-
ment in the County Jail for a period not to exceed ten
(10) days, or by both such fine and imprisonment.
In all matters and things not otherwise provided for
herein, the proceedings shall be governed by "Robert's
Rules of Order", Revised Edition. However, no
resolution, proceeding o other action of the
Commission shall be invalidated, or the legality
thereof otherwise effected, by the failure or omission
to observe or follow said rules."
SECTION 5. This ordinance shall take effect and be in
force on and after March 5, 1974, and prior to the
expiration fifteen (15) days after the passage thereof,
this ordinance shall be published once in the Coastline
Dispatch, a newspaper of general circulation in the City
of San Juan Capistrano, County of Orange, State of Cali-
fornia.

URGENCY. This ordinance is an urgency ordinance for the
immediate preservation of the public's health, safety and welfare,
and shall take effect immediately The facts constituting this
urgency are as follows:

This ordinance was given first and second reading, with
adoption thereof on December 17, 1973. It was inadvertently not
published, thus necessitating a readoption procedure. Inasmuch as the
public has had ample notification and opportunity to be heard with
respect to this ordinance, and there is no further public purpose
to be served by an additional reading, it is deemed appropriate to now
give Ordinance No. 252 urgency adoption.
ADOPTED AND APPROVED this 7th day of January, 1974, by the
following vote, to wit:
