AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO
AMENDING PORTIONS OF ORDINANCE NO. 56 RELATING
TO THE PAYMENT OF FEES FOR THE PROCESSING OF
SUbDIVisiOAb AND OTHER DIVISIONS OF LAND AND
AMENDING PORTIONS OF ORDINANCE NO. 115 RELA^1ING
TO FEES PAYABLE FOR MATTERS PROCESSED BY THE
PLANNING DEPARTMENT.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES ORDAIN AS
FOLLOWS:
SECTION 1. Subdivision Ordinance. Ordinance No. 56 is amended
in the following respects:
"SECTION 4.04 - REQUIRED FEES, FILING OF TENTATIVE.
A. SUBDIVISION OF FOUR OR LESS LOTS.
1. For each subdivision, a fee of one hundred dollars
($100.00) shall be paid at the time of filing the application.
B. SUBDIVISION OF FIVE OR MORE LOTS.
1. The tentative map filing fee shall be a minimum of
fifty dollars ($50.00) and fifty cents ($0.50) per lot or unit whichever
shall be the greater. Such fees shall be calculated on the numbered lot
count shown on the tentative map as first filed, no refund or additional
fee shall be made because of any reduction in numbered lots caused by
any revision or re -design of the plan for the same parcel of property.
When additional property is added to a tentative map, previously filed,
the fee for such added property shall be fifty cents ($0.50) for each
numbered lot so added. No fefund of such filing fee shall be made
for any tentative map or portion thereof deleted, withdrawn or
abandoned.
SECTION 5.03 - FEES.
_ 1. RECORD OF SURVEY CHECKING FEE. In addition to all other
fees, charges and deposits required by law, the subdivider shall pay a
plan -checking fee to the City Engineer upon submitting a final Record
of Survey within the incorporated area of the City. This fee for
examining and checking the Record of Survey shall be thirty ($30.00)
dollars, plus the sum of two ($2.00) dollars for each parcel or unit,
whichever shall be the greater shown on the map.
2. IMPROVEMENT PLAN CHECKING FEE. At the time of submission
of the improvement plans to the City Engineer for checking, a feeof
fifty ($50.00) dollars plus four ($4.00) dollars a lot or unit, which-
ever shall be the greater shall be paid to the City.
3. INSPECTION FEES. All construction shall be subject to
inspection by the City Engineer and the subdivider shall arrange for
such inspection prior to the starting of construction of the improve-
ments. The actual cost of such inspection shall be paid by the sub-
divider. Before filing of the Final Map the subdivider shall deposit
with the City fees in the following amcn:nts:
Three and one-half (3-1/2) percent of the estimated
total cost of improvements. The City Engineer shall make an estimate
of these improvement costs. The unit price used in such estimate
shall be the prevailing construction costs in Orange County over the
past year and these unit costs shall be periodically reviewed and
brought up to date. No adjustment in or refund of such fees shall be
made once such fees have been paid.
SECTION 6.04 - TRACT MAP CHECKING FEE. In addition to all other
fees, charges and deposits required by law, the subdivider shall pay a
plan -checking fee to the City Engineer upon submitting a Final Map of
a subdivision in the incorporated area of this City. The fee for
examining and checking a Final. Map shall be thirty ($30.00) dollars,
plus the sum of two ($2.00) dollars for each lot or unit, whichever is
the greater shown upon said map.

SECTION 7.03 - IMPROVEMENT PLANS AND PROFILES.
B. IMPROVEMENT PLAN CHECKING FEE. At the time of submission
of the improvement plans to the City Engineer for checking, a fee of
fifty ($50.00) dollars plus four ($4.00) dollars a lot or unit, which-
ever is the greater shall be paid to the City. Said fees shall not be
charged for a subdivision consolidating properties into one (1) lot or
for a subdivision for the purpose of revision to acreage."
SECTION 2. Repeal. Subsection 5 of Section 5.08 and Section
6.22 of Ordinance No. 56 relating to City Lot Division Fees, be 'and
are hereby repealed.
SECTION 3. Ordinance No. 115 be and is hereby amended in the
following respects. -
"4.12.7 - FEES.
A. Applicant shall be required to pay a fee of $25.00
plus $2.00 per acre for the processing of all residential site plans.
4.13.15 - FINAL SITE PLAN PROCESSING FEE.
A. The applicant shall be required to pay a fee of $25.00
per gross acre for the processing of any and all non-residential site
plans.
6.02.1 - Except for land use applications relating to condi-
tional uses and variances, the City shall charge and collect a fee of
two hundred and fifty ($250.00) dollars for the filing of each Land
Use Permit application.
10.01.2 - Whenever the owner of any land desires a reclassi-
fication of his property, he shall pay a fee of two hundred fifty
($250.00) dollars to the City.
SECTION 4. On and after the effective date of this Ordinance,
the City Council be and is hereby empowered to establish, change,
amend or delete any fee or charge in Ordinances No. 56 and 115 by
resolution.
SECTION S. The City Clerk shall certify to the adoption of this
ordinance and cause the same to be published within fifteen (15) days
following said adoption in a newspaper of general circulation in the
City of San Juan Capistrano.
