AMENDMENT TO REZONE 78-1 (ORTEGA PROPERTIES)
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING ORDINANCE NO. 379 BY
AMENDING THE PERMITTED USES IN PLANNING SECTOR C
AS DEFINED IN COMPREHENSIVE DEVELOPMENT PLAN 78-1
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
That the amendment of Ordinance No. 379 amending the
permitted uses in Planning Sector C as defined in Comprehensive
Development Plan 78-1 is consistent with the General Plan of the
City of San Juan Capistrano and the development thereof will
conform to standards of Ordinance No. 293.
SECTION 2. Amendment to Comprehensive Development
Plan 78-1.
That the Comprehensive Development Plan 78-1 heretofore
adopted on January 3, 1979, by Ordinance No. 379 is hereby amended
as follows:
1. General Office uses such as business, professional,
real estate, and similar office uses for that
portion shown on the area plan for Planning Sector
C. In no event shall retail uses be permitted.
2. Parking lots to serve adjacent uses in Planning
Sector B provided a joint parking agreement is
entered into between the developer and the City
and which does not represent a majority of the
parking requirements for the subject use. Said
parking facility shall not be constructed until
the open space area adjacent has been developed.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force 30
days after its passage.
SECTION 4. Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within 15
days after its passage.
PASSED, APPROVED AND ADOPTED this 6th day of
June 1 1979, by the following vote, to wit:
AYES: Councilmen Hausdorfer, Schwartze, Thorpe,
Buchheim and Mayor Friess
