ORDINANCE NO. 356
BUILDING AND HOUSING CODE FEES
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ESTABLISHING A BUILDING PERMIT FEE
SCHEDULE AND AMENDING ORDINANCE NO. 268
(URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Recitations.
a. The City of San Juan Capistrano has heretofore
adopted by reference Ordinance No. 2742 of the
County of Orange which in turn adopted the Uniform
Building Code, 1973 Edition and Uniform Housing
Code, 1973 Edition, with certain exceptions and
amendments thereto.
b. Effective July 1, 1978, the City of San Juan
Capistrano will undertake the administration of
all functions relating to the issuance of permits
and enforcement of ordinances relating to building
and safety.
SECTION 2. Amendments.
That portion of County of Orange Ordinance No. 2742
adopted by City of San Juan Capistrano Ordinance No. 268 and
appearing as a part of Sections 7-1-18 and 7-1-22 of the Codified
Ordinances of the County of Orange and setting forth the building,
plan check and lath and plastering permit Schedule of Fees are
amended to read as follows:
SCHEDULE OF FEES
VALUATION OF CONSTRUCTION COSTS
1. Section 423 of the Uniform Building Code requires a
value or valuation be placed on new construction
equivalent to the estimated cost to replace the building
in kind. In performance of this section of the Uniform
Building Code, the City of San Juan Capistrano adopts
the Steven's Valuation Quarterly for unit costs per
square foot. These unit costs include architectural,
structural, electrical, plumbing and mechanical work.
2. These values will be used to establish fees and/or
costs based on value of the work to be performed.
3. The Building Official of the City of San Juan Capistrano
will designate the Steven's Valuation to be used and
the effective date of any changes thereof.
BUILDING PERMIT FEES
A fee of $5.00 will be charged as a permit issuance fee
for each building permit issued.

PLAN CHECK FEES
When a plan is required to be submitted by subsection (c)
of Section 301 of the Uniform Building Code, a plan
check fee shall be paid at the time of submitting plans
and specifications for checking. The plan check fee
shall be equal to SIXTY PERCENT (608) of the building
permit fee. If the valuation exceeds $50,000.00, the
plan checking fee shall be SIXTY-FIVE PERCENT (658) of
the building permit fee.
LATH AND PLASTER PERMIT FEES
All persons doing or permitting to be done any plastering
work, interior or exterior, within the area covered by the
City of San Juan Capistrano Regulations, shall:
1. Apply for a permit to plaster and specify, on the form
provided for that purpose, the character of the work
proposed and the amount and kind of work to be done.
2. Pay for each permit issued at the time of issuance a
fee in accordance with the listed schedule.
3. Any person who shall commence plastering work for which
a permit is required without first having obtained a
permit, shall if subsequently permitted to obtain a
permit, pay double the permit fee plus any penalties in
effect.

MICROFILM FEES
Each person, firm, or corporation shall pay a microfilm fee
of $.30 per sheet for permit applications, plans, specifications,
calculations, soil reports, and all pertinent data required
to be maintained by City or State regulations. No sheet
shall exceed a width of 36 inches, nor 45 inches in length.
SPECIAL REQUEST INSPECTIONS
Any person, firm, or corporation requesting an inspection on
existing structures whereby no valid permit exists or no
active permit is in progress may obtain a "Special Inspection"
for purposes of loan commitments, escrow clearance, sale of
property, resale clearance, etc.

SECTION 3
Effective Date.
This is an Urgency Ordinance to preserve the health,
safety and welfare of the City of San Juan Capistrano, and shall,
accordingly, become effective July 1, 1978. The reasons for the
urgency are that, on July 1, 1978, the City of San Juan Capistrano
will undertake the full responsibility for the issuance of building
permits within the City limits; a fee schedule reflecting the
current cost of providing such services is necessary to preserve
and maintain the fiscal well-being of the City.

SECTION 4. Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.

June 1 1978, by the following vote, to wit:
