ORDINANCE NO. 353
MOGAN ANNEXATION
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, APPROVING THE MOGAN ANNEXATION TO
THE CITY
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby finds and determines
as follows:
A. The Orange County Local Agency Formation Commission
(LAFCO) approved the annexation, described herein
as the Mogan Annexation to the City of San Juan
Capistrano, on January 11, 1978.
B. The LAFCO approval was subject to the requirement
that two additional properties, identified as the
Lashbrook and Mansell properties, be included
within the annexation area in order to avoid the
creation of a small pocket of unincorporated
territory.
C. On February 15, 1978, the City Council adopted a
resolution initiating annexation proceedings for
the area composed of the Mogan, Lashbrook, and
Mansell properties.
D. On April 5, 1978, pursuant to Section 35310 et'
seq. of the California Government Code, the City
Council held a duly noticed hearing to receive
protests on the proposed annexation by affected
property owners. In accordance with the criteria
of Section 35313 of the Government Code, the City
Council has determined that no majority protest
has been made.
E. Annexation of the properties in question is
proper and desirable for the following reasons:
1. The annexation area is within the City's
approved sphere of influence.
2. The property is within the boundaries of
Orange County Waterworks District No. 4, a
subsidiary district of the City.
3. All other required municipal services can be
effectively supplied by the City.
4. The City has approved pre -zoning of the Mogan
property preparatory to annexation proceedings.
5. The City has reviewed and has approved a
tentative map for the Mogan property.
SECTION 2. Annexation. Because of the findings in
Section 1 preceding, the City Council does hereby approve the
Mogan Annexation'to the City of San Juan Capistrano. Therefore,
from and after the effective date of this Ordinance and completion
of the necessary LAFCO and State certification requirements, the

territory described in Exhibit "A", herein shall be deemed an
integral part of the City of San Juan Capistrano. All property
therein shall be subject to taxation equally with property
within the City of San Juan Capistrano.
SECTION 3. This Ordinance shall take effect and be in
force 30 days after its passage.
SECTION 4. The City Clerk shall certify to the
adoption of this Ordinance and cause the same to be posted in
the duly designated posting places within the City of San Juan
Capistrano within 15 days after its passage.
PASSED, APPROVED AND ADOPTED this 3rd day of
May 1 1978 , by the following vote, to wit:
AYES: Councilmen Hausdorfer, Schwartze, Thorpe,
Buchheim, and Mayor Friess
