ORDINANCE NO. 443
PHYSICALLY HANDICAPPED PARKING
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ADDING SECTION 4-6.322 TO THE
MUNICIPAL CODE, ESTABLISHING ON AND OFF-STREET
PARKING SPACES FOR EXCLUSIVE USE OF PHYSICALLY
HANDICAPPED PERSONS WHOSE VEHICLES DISPLAY A
DISTINGUISHING LICENSE PLATE PURSUANT TO THE
REQUIREMENTS OF SECTIONS 9105, 21107.8,
22507.8 AND 22511.5 C.V.C.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Short Title.
This Ordinance shall be known and may be cited as the
Physically Handicapped Parking Ordinance of the City of San Juan
Capistrano.
SECTION 2.
Section 4-6.322 is hereby added to read as follows:
"Section 4-6.322. Parking for Physically
Handicapped Persons.
"A. Definitions.
"(1) On -street parking shall mean vehicle parking
on public ways.
"(2) Off-street parking facility shall mean any
publicly or privately owned parking lot or
facility located off the public way for the
express purpose of providing vehicular
parking.
"(3) Physically handicapped persons shall mean any
person who has lost the use of one or more
limbs or both hands or is so severely disabled
as to be unable to travel at a reasonable
rate of speed with or without the aid of a
mechanical device.
"B. Establishment of On -Street Parking Spaces.
"The Traffic Engineer is hereby authorized to
designate parking spaces for the exclusive use of physically
handicapped persons whose vehicles display a distinguishing
license plate issued to disabled persons pursuant to Section
22511.5 of the Vehicle Code or to disabled veterans, as
specified in Section 9105 of the Vehicle Code. Such parking
spaces shall be indicated by blue paint on the curb or on
the edge of the paved portion of the street, adjacent to each
space. In addition to blue paint, each space shall also be
indicated by standard approved signs consisting of a profile
view of a wheelchair with occupant in white on a blue background
posted immediately adjacent to, or visible from, each parking
space.

"C. Establishment of Off -Street Parking Spaces.
"(1) The Traffic Engineer is hereby authorized to
designate spaces publicly owned or leased
off-street parking facilities for the exclusive
use of physically handicapped persons whose
vehicles display a distinguishing license
plate issued to disabled persons pursuant to
Section 22511.5 of the Vehicle Code or to
disabled veterans, as specified in Section
9105 of the Vehicle Code.
"Such designation shall be made by posting a
sign immediately adjacent to and visible from
each stall or space, consisting of a profile
view of a wheelchair with occupant in white
on a blue background. In addition to the
signs, such spaces may also be identified by
a painted message and/or symbol on the
pavement within each space.
(2) The Traffic Engineer is hereby authorized to
designate spaces in privately owned and
maintained off-street parking facilities
generally held open for the use of the public
for the purpose of vehicular parking for the
exclusive use of physically handicapped
persons whose vehicles display a distinguishing
license plate issued to disabled persons
pursuant to Section 22511.5 of the Vehicle
Code or to disabled veterans as specified in
Section 9105 of the Vehicle Code., Such
designation shall be made by posting a sign
immediately adjacent to and visible from each
stall or space, consisting of a profile view
of a wheelchair with occupant in white on a
blue background. In addition to the signs,
such spaces may also be identified by a
painted message and/or symbol on the pavement
within each space.
"Pursuant to Vehicle Code Section 22107.8, the
provisions of the Vehicle Code Section
22507.8 hereby is made applicable to the
aforesaid off-street parking facilities.
"This subsection, C(2), shall not be
effective unless the owner and operator of
the off-street parking facilities described,
causes to be posted in a conspicuous place at
each entrance to such off-street parking
facility a sign stating that the facility is
subject to public traffic regulations and
control in compliance with Vehicle Code
Section 21107.8b. The owner and operator of
the privately owned and maintained off-street
parking facilities shall be responsible for
posting signs and painting stalls for
handicapped usage and for maintaining these
facilities.
"(3) There may also be posted immediately adjacent
to and visible from each space, a sign which
clearly and conspicuously states the following:

'Unauthorized vehicles not displaying
distinguishing license plates issued to
physically handicapped persons will be
towed away at owner's expense. Towed
vehicles may be reclaimed at
or by telephoning
"When such a sign is posted, the Traffic
Engineer shall cause the specific sign
information to be completed and maintained to
set forth the following:
"1. The complete name, address and
telephone number of the place where
the vehicle may be reclaimed.
"2 The applicable name and telephone
number of the local law enforcement
agency."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 4. Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 17th day of
November 1 1981 . by the following vote, to wit:
