ORDINANCE NO. 440
AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE -
PROVIDING FOR AN FM (FARM MARKET) DISTRICT
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, ADDING SECTION 9-3.423.3 TO THE
MUNICIPAL CODE, PROVIDING FOR AN FM (FARM MARKET)
DISTRICT
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
A. The City's Environmental Review Board has reviewed
the amendment as set forth herein, has determined
that it will not have a significant impact on the
environment, has accordingly issued a negative
declaration, and has otherwise carried out all
requirements of the California Environmental
Quality Act as amended.
B. This Code Amendment will provide a new District
for the sale of farm produce and related
convenience items and will thus promote the
economic viability of farm operations and allow
retail facilities that are oriented to and
supportive of the agricultural operations of which
they are a part.
SECTION 2. Amendment Text.
A. introduction
Based on the findings set forth in Section 1,
preceding, the amendments to Title 9 of the
Municipal Code, set forth in Paragraphs B and C,
following, are hereby enacted:
B. Amendment to Consistency Matrix
Table 2-1 of Section 9-2.101 is hereby amended to:
(1) add the FM, Farm Market District to the Zone
District designations along the top row; (2) add
an Agri -Business, 4.2, General Plan designation to
the left-hand column; and (3) delete the 2.6
"Agriculture" and the "Agriculture Overlay"
designations from the left-hand column. The
existing AG and GM and the new Farm Market zone
districts shall then be designated as consistent
with the 4.2 Agri -Business General Plan
designation by inserting an "X" in the AG, GM and
FM columns opposite Agri -Business.
C. Addition of FM District Regulations
Section 9-4.423.3 is hereby added to the Municipal
Code, to read as follows: -
"Section 9-3.423.3 FM - Farm Market District
"(a) Purpose and Intent
"To provide retail facilities that are oriented
to and supportive of the agricultural operation
of which they are geographically a part.

"To implement the General Plan concept of
promoting the economic viability of farming
operations by providing for the retail sale
of farm products.
"To encourage the sale of farm -fresh produce
in order to enhance the City's character as a
semi -rural community.
"(b) Principal Uses and Structures Permitted:
"(1) Ranch market or country store whose main
function is the sale of fresh farm
products. Bakery goods, fresh meats and
other specialty items may also be
incorporated within the ranch market.
(Such collateral uses may have an outside
entrance separate from the main entrance
to the ranch market.) In addition, the
package sale of beer and wine is permitted,
provided such sale is incidental to the
principal retail operation and there is
no consumption on the premises.
11(2) Farm supply and feed stores.
"(3) Retail and wholesale nurseries and
garden supply stores.
11(4) Warehouse and storage facilities for
farm products.
"(5) Equestrian and leather equipment sales
and repair.
"(6) Labs, together with related offices, for
agricultural consultants, pesticide or
chemical distributors or farm service
organizations.
"(7) Retail sale and small-scale finishing or
working of such materials as leather,
pottery, jewelry and similar items,
providing it is incorporated within the
ranch market and is incidental to the
market's main function.
"(c) Accessory Uses and Structures Permitted:
"(1) Outside sale, display and storage in
accordance with Section 9-3.616.
"(d) Conditional Uses and Structures Permitted:
"(1) Snack bar or delicatessen, providing it
is incidental to the market's main
function.
"(e) Development Standards:
"(1) Minimum Lot Size 1.5 acres
11(2) Maximum Development Size 4 acres
"(3) Minimum Street Frontage 250 feet

"(f) Development Plans and Review:
"(1) Projects proposed within the FM District
shall be subject to the Development
Review process for site plan approval
pursuant to the provisions of Section
9-2.305. Setbacks and building heights
shall be in accordance with the approved
site plan upon determination by the
Planning Commission that the development
creates a rustic, rural image and has no
adverse effect on adjacent properties.
"(2) Plans required for review of projects
within the FM District include:
"a. site, plot or development plans
"b. grading plan
"c. landscaping plan
"d. building elevations
"e. architectural detail plans (such as
for trash areas, light fixtures,
and similar items)
"(g) Supplementary District Regulations:
"The Supplementary District Regulations of
Article 9-6 shall apply to this district
except when inconsistent with the following
provisions, in which event the following
standards shall prevail:
"(1) Developments in this district shall
incorporate low profile buildings and a
rustic atmosphere to enhance the rural
environment of the community.
"(2) Development within this district shall
establish an early California or western
theme. Building architecture, the
character of the parking area, and the
style of landscaping shall be consistent
with this theme.
"(3) Parking
a. Continuous curbs and/or headers
shall be wooden.
"b. Parking facility light fixtures
shall complement the development's
theme.
"c. All other parking regulations shall
be in accordance with Section
9-3.602.
"(4) Signs
"a. The materials, lettering style and
color of the signs shall be consistent
with the theme established for the
project.

"b. Internally illuminated signs within
this district are prohibited.
C. All other sign regulations shall be
in accordance with Section
9-3.603."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.
SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted in the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 17th day of
November r 1981, by the following vote, to wit:
AYES: Councilmen Friess, Hausdorfer, Bland,
and Mayor pro tem Buchheim
