ORDINANCE NO. 435
AMENDMENT TO TITLE 9 OF THE MUNICIPAL CODE -
MOBILEHOME PARK DISTRICT REGULATIONS
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING SECTION 9-3.408 AND
SECTION 9-3.602 OF THE MUNICIPAL CODE,
REGULATING MOBILEHOME PARK DEVELOPMENTS
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has
reviewed the Code Amendment set forth herein,
has determined that the amendment will not have
a significant effect on the environment, has
accordingly issued a negative declaration for
the amendment, and has otherwise carried out all
requirements of the California Environmental
Quality Act.
2. The Code Amendment will clarify mobilehome park
development standards while giving the City more
specific regulation of the development of
individual spaces within mobilehome parks.
SECTION 2. Text of Amendments to Title 9 of the
Municipal Code.
A. Introduction
Based on the findings set forth in Section 1,
the amendment to Title 9 of the Municipal Code
set forth in Paragraphs B through G, following,
is hereby enacted.
B. Subsection 9-3.408(b)(1) is hereby amended to
include only the following permitted principal
use (without the requirement for a Conditional
Use Permit):
"(1) Parks, public and private."
C. Existing Paragraph (d) of Section 9-3.408 is
hereby relettered as Paragraph (e); new Paragraph
(d) shall then be added to read as follows:
"(d) Conditional uses and structures permitted.
The following uses and structures may be
permitted in the Mobilehome (MHP) District,
subject to the approval of a Conditional
Use Permit:
"(1) Mobilehome parks."
D. Existing Paragraph (e) of Section 9-3.408
(Development Standards) is hereby relettered as
Paragraph (f) and shall be amended to read as
follows:
(1) Minimum individual mobilehome pad or
space area: 4,000 square feet.

"(2) Minimum individual space street
frontage: 60 feet.
11(3) Minimum setbacks from mobilehome
coaches and the coach's attached and
detached accessory structures to
adjacent space lines shall be as
follows:
"(i) side yard - five (5) feet
"(ii) rear yard - three (3) feet
"(iii) front yard - three (3) feet
11(4) Minimum distance between any structure
and any project boundary or exterior
lot line shall be ten (10') feet.
11(5) Setback reductions - On existing
spaces within mobilehome parks
"established prior to November 5, 1981,
with less than a 60 -foot street
frontage, the side setback for open
accessory structures may be a minimum
of three feet to the space line
instead of the five feet required for
60 -foot wide spaces.
11(6) Specific Plan Requirements - Mobilehome
parks subject to a duly -adopted
Specific Plan shall conform to the
standards of this Section except where
the Specific Plan sets forth specific
other requirements different from
those in this Section.
"(7) Planned Development Mobilehome Park -
Standards other than those set forth
in this Section may be adopted for a
new mobilehome project if a Specific
Development Plan and PD (Planned
Development) zoning are approved prior
to development of the project."
Existing Paragraphs (f) and (g) of Section
9-3.408 are hereby relettered as Paragraphs
(g) and (h), respectively.
Subsection 9-3.602(g)(2)(iv) regarding
minimum off-street parking space
requirements for mobilehome parks is hereby
amended to read as follows:
"(iv) 2.0 per dwelling site, at least
one space per dwelling to be
covered, plus .4 spaces per
dwelling site for visitor parking,
plus the spaces required for
recreation centers, if any.
Visitor parking shall be evenly
distributed throughout the park.
The parking required per dwelling
may be provided as tandem parking,
if approved by the decision-
making body during development
review."
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force
thirty (30) days after its passage.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted inthe duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 6th day of
October , 1981 , by the following vote, to wit:
AYES: Councilmen Friess, Hausdorfer, Bland,
Buchheim and Mayor Schwartze
