Ordinance Number 433ORDINANCE NO. 433 AMENDMENT TO TITLE 9, CHAPTER 3, ARTICLE 4 OF THE MUNICIPAL CODE - MOBILEHOMES AND MODULAR HOMES IN SINGLE-FAMILY RESIDENTIAL DISTRICTS AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING TITLE 9, CHAPTER 3, ARTICLE 4, OF THE MUNICIPAL CODE TO PERMIT THE INSTALLATION OF MOBILEHOMES AND MODULAR HOMES ON A FOUNDATION SYSTEM ON LOTS ZONED FOR SINGLE-FAMILY DWELLINGS AND TO ESTABLISH DEVELOPMENT STANDARDS FOR SINGLE-FAMILY DWELLINGS THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. The City Council finds that: A. The City's Environmental Review Board has reviewed the Code Amendment set forth herein, has determined that the amendment will not have a significant effect on the environment, has accordingly issued a negative declaration for the amendment, and has otherwise carried out all requirements of the California Environmental Quality Act. B. The Code Amendment will permit mobilehomes and modular homes on a foundation system on lots zoned for single-family dwellings in order to provide affordable housing opportunities. C. The Code Amendment will establish specific development standards for all single-family dwellings (site -built, modular or mobilehome) to avoid potential blight by requiring materials which combine good durability with pleasing appearance. SECTION 2. Text of Amendment to Title 9 of the Municipal Code. A. Based upon the findings set forth in Section 1, above, the amendment to Title 9 of the Municipal Code set forth in Paragraphs B and C, following, is hereby enacted. B. Sections 9-3.401(b), 9-3.402(b), 9-3.403(b), 9-3.404(b), 9-3.405(b), 9-3.406(b), and 9-3.409(b) are hereby amended to include the following two items as permitted principal uses: * "Single-family dwelling, standard wood frame construction on-site, subject to the provisions of Section 9-3.424(b)ll. * "Mobilehomes and modular homes on a permanent foundation system if the Planning Commission determines that the lot proposed is compatible for such use. Both shall be subject to the provisions of Section 9-3.424(b)ll." The Planning Commission shall use said provisions as guidelines to assist in its determination of compatibility. on 110 C. Section 9-3.424(b)ll is hereby added to read as follows: "11. Single-family development standards. In all Districts where single-family dwellings (site -built, modular or mobilehome) are permitted, said dwellings shall be subject to the development standards for that District as well as the following requirements: "i. The minimum width shall be 20 feet outside dimension measured to the building line. For the purpose of this section, width shall be distinguished from length of the building as the dimension having the lesser measurement. "ii. The exterior sides shall be covered with wood, stucco, masonry, or other material of similar texture and durability. Metal siding is not permitted. "iii. The roof material shall be wood shingle or shake, slate, tile or other material of similar appearance, texture, substance, and durability. Rock, asphalt shingle or metal roofs are discouraged. "iv. Roof eaves and gables shall be no less than twelve inches, measured from the vertical side of the unit, unless other- wise approved by the Planning Commission. 'IV. Exterior colors which blend the structure into the surrounding landscapp are encouraged (e.g., browns, siennas, grays). Bright or garish colors are discouraged." The preceding criteria shall be administered by the City body which is responsible for reviewing residential projects or custom homes prior to plan check. In the case of mobilehomes and modular homes, the Planning Commission shall use said criteria to assist in its determination of the compatibility of the proposed lot for such use. SECTION 3. Effective Date. This Ordinance shall take effect and be in force 30 days after its passage. SECTION 4. City Clerk Certification. The City Clerk shall certify to the adoption of this Ordinance and cause same to be posted in the duly designated posting places within the City of San Juan Capistrano within 15 days after its passage.
