Ordinance Number 418ORDINANCE NO. 418 REZONE 80-3 (FORSTER CANYON PLANNED COMMUNITY AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP ADOPTED BY ORDINANCE NO. 398 BY CHANGING THE ZONING OF ASSESSOR'S PARCEL NOS. 124-110-1, 124-110-3, 124-110-16, 124-110-49, 124-110-51 AND 124-110-63, 124-120-4, 124-120-25, AND 675-081-4, 675-081-10, 675-081-11 AND PORTIONS OF 675-081-13 FROM GM (GROWTH MANAGEMENT) TO PC (PLANNED COMMUNITY) THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. FINDINGS. The City Council finds that: The City's Environmental Review Board has reviewed the subject zone change application, has determined that the project will have a significant effect on the environment, has required the preparation of an Environmental Impact Report, and has otherwise carried out all requirements of the California Environmental Quality Act. (The environmental impact report prepared for the project has been certified as adequate.) The development concepts regarding land use, density and general location are consistent with the applicable goals, policies, and objectives of the General Plan. This finding is based upon the following considerations: a. The general location of the proposed land uses is consistent with the General Plan Composite Map. b. The density of development is generally consistent with the General Plan designations shown on the composite map. General Plan Amendment 78-1 designated a public/institutional site on Window Hill; however, it was noted in the amendment text that the public/institutional use could be located anywhere within the project area. The applicant has proposed to locate the site in the "Mesa" area outside the limits of the former landfill site. In response to this proposed change in location, an analysis has been prepared in the EIR which addresses the feasibility of the proposed site. General Plan Amendment 78-1 designated the general landform constraints to be used in the stabilization of Window Hill. In order to further evaluate the grading concepts and necessary refinements in techniques, the Comprehensive Development Plan includes a Landform Control District. The inclusion of the Landform Control District is designed to insure that the intent and purpose of the General Plan Amendment will be satisfied upon implementation. -1- General Plan Amendment 78-1 provided a general alignment for the extension of Valle Road around the McCracken Hill knoll immediately adjacent to Interstate 5. During development of the conceptual development plans, staff and the applicants have reviewed several alternate alignments in order to avoid major environmental impacts. The results of these studies indicate that the preferred alignment using a portion of the existing roadway serving McCracken Hill and around the top of the knoll is the most environmentally sensitive design and consistent with the general intent of the General Plan. General Plan Amendment 78-1 provided for a bikeway link and equestrian/hiking trails between Camino Las Ramblas and San Juan Creek Road. The general alignment followed the roadway design for the extension of Valle Road. Based upon recognized design constraints regarding percent grades, the alignment has been modified to go through the "Valley" portion of the project connecting with the public/institutional site on the "Mesa." The same trail head connecting points will be maintained at Camino Las Ramblas and San Juan Creek Road. , The development of the property under the proposed zoning will conform to the development standards and other applicable provisions of Ordinance No. 398 and the Forster Canyon Planned Community Comprehensive Development Plan. 4. A duly -noticed public hearing has been held to receive and consider public testimony regarding the proposed zone change. SECTION 2. ZONE CHANGE. Based on the findings set forth in Section 1, preceding, the City Council ordains that the official zoning heretofore adopted for Assessor's Parcel Nos. 124-110-1, 124-110-3, 124-110-16, 124-110-49, 124-110-51 and 124-110-63, 124-120-4, 124-120-25 and 675-081-4, 675-081-10, 675-081-11 and portions of 675-081-13 on February 20, 1980, by Ordinance No. 398 be changed from GM (Growth Management) to PC (Planned Community). Said zone change is designated herein as Rezone 80-3 and is more specifically depicted on Exhibit "A" and "B" attached hereto by this reference. SECTION 3. EFFECTIVE DATE. This Ordinance shall take effect and be in force Thirty (30) days after its passage. -2- SECTION 4 CITY CLERK'S CERTIFICATION. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted in the duly -designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
