AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING TITLE 2, CHAPTER 2, ARTICLE
3, OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE -
CULTURAL ARTS AND HERITAGE COMMISSION (URGENCY)
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Amendment.
Title 2, Chapter 2, Article 3, of the San Juan
Capistrano Municipal Code is hereby amended to read as follows:
"Article 3. Cultural Arts and Heritage Commission
"Section 2-2.301. Created.
"A Cultural Arts and Heritage Commission for the
City is hereby created.
"Section 2-2.302. Membership.
"The Cultural Arts and Heritage Commission shall
consist of seven (7) members, two (2) of whom are not
required to be resident electors of the City. A quorum
shall consist of not less than four (4) members, and
any action of the Commission shall require an
affirmative vote of not less than four (4) voting
members.
"Section 2-2.303. Duties.
"The Cultural Arts and Heritage Commission shall
undertake and have the following duties,
responsibilities, and functions, together with the
- powers incidental thereto:
"(a) Generally, to act in an advisory capacity to
the Council, planning Commission, City staff,
and any other group which the Council might
designate in all matters pertaining to the
culture, heritage, and history of the City;
"(b) To promote an awareness of and appreciation
for the City's cultural and historical
significance through preservation and
promotion of the cultural arts. The
Commission shall encourage the sponsorship of
community events and activities which promote
the history and culture of the community, and
shall assist community organizations and
other City boards and commissions in
undertaking such tasks;
"(c) To compile, keep, and maintain a list of all
sites, structures, persons, events, and
landmarks which have cultural or historical
significance or importance. Such list shall
be submitted to the Council for its review.
The Commission shall notify the owner of any
item on the list of any special City
requirements applicable to his property;
"(d) To implement and administer studies and plans
relating to matters of historical, cultural,
paleontological, or archaeological
significance and to make recommendations on
the designation and creation of historical,
cultural, paleontological, or archaeological
districts;
"(e) To recommend to the Council an annual budget
including the following:
"(1) Financing of the activities of the
Commission; and,
11(2) The capital projects designated to
protect the cultural heritage of the
community.
"The Commission shall also investigate the
availability of funding programs through
State and Federal agencies; and,
"(f) To undertake such other duties as may be
assigned by the Council."
SECTION 2. Effective Date.
This is an urgency Ordinance affecting the public
welfare of the City of San Juan Capistrano and shall, accordingly,
take effect immediately. The nature of the urgency relates to
the necessity of creating a fully -constituted commission able to
deliberate and make recommendations upon items to be presented at
a regular Commission meeting set for May 24, 1984.

SECTION 3. Citv Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted at the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.
PASSED, APPROVED AND ADOPTED this 15th day of May ,
1984, by the following vote, to wit:
AYES: Councilmen Friess, Bland, Buchheim,
Schwartze, and Mayor Hausdor£er
