AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING THE SAN JUAN CAPISTRANO
MUNICIPAL CODE BY ADDING SECTION 9-3.624 TO
TITLE 9, CHAPTER 3, ARTICLE 6 THAT ESTABLISHES
SERVICE STATION STANDARDS
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,�CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings.
The City Council finds that:
1. The City's Environmental Review Board has reviewed
the subject Code Amendment, has determined that
the project will not have a significant effect on
the environment, has certified the issuance of a
Negative Declaration, and has otherwise carried
out all requirements of the California
Environmental Quality Act.
2. The proposed Code Amendment is consistent with the
goals and policies of the General Plan.
3. A duly noticed public hearing has been held to
receive and consider public testimony regarding
the proposed Code Amendment.
SECTION 2. Zone Change.
Based on the findings set forth in Section 1,
preceding, the City Council ordains that the San Juan Capistrano
Municipal Code is hereby amended by adding Section 9-3.624
(Service Station Standards) to Title 9, Chapter 3, Article 6
(Supplementary District Regulations). Said amendment is
designated herein as Code Amendment 83-2 and is more specifically
depicted on Exhibit "A," attached hereto.
SECTION 3. Effective Date.
This Ordinance shall take effect and be in force thirty
(30) days after its passage.

SECTION 4. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause same to be posted at the duly designated
posting places within the City of San Juan Capistrano within
fifteen (15) days after its passage.

February 1984 , by the following vote, to wit:

SECTION 9-3.624 - SERVICE STATIC.. STANDr-RDS
A. Intent and Purpose - It is recognized that service
stations warrant special attention in this code because
tilty constitute a use attracting vehicular patronage
exclusively. It is further noted that the exposed
nature of the activity, distinctive physical appearance,
and long hours of operation necessitate special require-
ments to insure compatibility with the City's General
Plan as it relates to aesthetic and visual aspects.
B. Conditional Use Permit - Service stations may be
established subject to approval of a Conditional Use
Permit for the CN (Neighborhood Commercial), CG (General
Commercial), CM (Commercial Manufacturing), PD (Planned
Development), and PC (Planned Community) Districts.
C. Develo ment Standards - The following development
standards set forth in this subsection are the minimum
standards with which service stations and accessory
uses are evaluated:
1. Project Identification Signs - All project identifi-
cation signs shall conform to the design regulations
per Section 9-3.603 of the Municipal Code.
2. Price Sign Identification - In accordance with
Section 13531.5 of the Business and Professions
Code of the State of California, service stations
shall post all prices charged for the purchase of
vehicle fuels. Said signs shall conform to Section
13531.5 of the Business and Professions Code of the
State of California, subject to the following
design regulations:
a. Pricing Categories - Individual pricing signs
shall identify the price of all grades of
gasoline and diesel fuels sold on the premises,
including any differential between "self-
service" and "full service" and whether the
price is "cash" or "credit."
b. Advertising Medium - All letters, figures, or
numericals used on the sign designating the
price of gasoline or motor fuels shall be a
minimum six (6) inches and a maximum of nine
(9) inches in height. All letters or nt4nericals
designating the grade of gasoline or motor fuels
shall not be less than one-sixth the size of the
numericals designating the price. Said letters
shall have a medium or heavy typeface or
stroke and shall be plainly visible. Colors
of the letters shall contrast to the sign
background so as to be easily readable.

•c.Sign Location and Size - Price identification
signs shall be of a monument design with a
maximum height of eight (8) feet with a sign
face not exceeding thirty-two (32) square
feet. only one sign per street frontage shall
be permitted. The location of the sign shall
be approved by the Director of Community
Planning and Development and shall not conflict
with the vehicular sight distance requirements
of the current edition of the California Depart-
ment of Transportation, Highway Design Manual
(Section 9-3.605 of the Municipal Code).
d. Architectural Style and Color - The City
encourages the design and location of the
sign to be in harmony with the architectural
style of the building on the premises. The
use of earthtone mission colors shall be
encouraged. Examples of such colors include,
but are not limited to, browns, pale yellows,
tan, beige, and similar shades. The use of
an adopted lettering style or color scheme
for an individual company may be permitted.
However, if the color and/or lettering style
is in substantial conflict with the design
criteria, the applicant may be required
to modify the colors, materials, or other
design features to lessen the conflict with
the design criteria.
RecuiredSigns By Governmental Agency - Signs
required to be placed at a service station, including,
but not limited to, "No Smoking," "Licensed
Inspections and Adjustments," and similar identifi-
cation mandated by a governmental agency and not
otherwise provided for in this section, shall be
permitted.
Pump Island Signs - Signs designating operation
instructions, self -serve and full -serve islands,
cr similar information designed for customer
convenience provided the cumulative signage does
not exceed two square feet per island, shall be
permitted.
Window Signs - Temporary window signs may be
permitted provided they do not exceed 25 percent
of the window area and do not advertise merchandise
for which an alternate method of signage is permitted
by this section or other applicable provisions of
this article.

6. Prohibited Signs - All temporary signs not permitted
by this section or Section 9-3.623 (Special Activities
Permit) shall be prohibited.
7. ._Parking - The size, arrangement, and access of all
parking areas shall conform to Section 9-3.602.
All vehicles except those within the main structure
of the service station or those being serviced at
the pump islands shall be parked within the
designated parking spaces.
8. Outside Activities - Activities conducted outside
the permanent structure shall be limited to the
dispensing of gasoline, diesel fuel, oil, water
and minor repairs, such as replacement of fan
belts, light bulbs, wiper blades, batteries, and
tire changes. All repair activities shall be
confined to a designated area on the site as
approved by the City.

Of motor vehicles is strictly prohibited. For the
purposes of this section, "outside storage" shall
mean the parking of a motor vehicle outside the
main structure of the service -station for a period
in excess of twenty-four 0241 hours,, unless said
vehicle is in the process of being serviced, in
which case it may be parked outside the main
structure for a period not exceeding seven (7)
days and located in a designated parking space.
Said vehicles shall be stored in such a condition
that all exterior components of the vehicle are in
place (i.e. tires, doors, hoods, fenders, etc.).
10. Accessory Uses - The following accessory uses are
permitted:
a. Vending Machines - Vending machines shall be
either placed within the main building or in
a designated area immediately adjacent to the
building provided the area does not exceed
forty (40) square feet.
b. Merchandise Display - All merchandise shall
be stored and/or displayed within the permanent
building, with the exception of accessory and
lubrication items such as oil, wiper blades,
etc., which are normally kept on pump islands,
in which case they shall be located in a
specially designed case enclosure. Outside
display of any other merchandise shall be
prohibited, except during those occasions
when a Special Activity Permit has been
issued per Section 9-3.623.
